<br />310 Sunshine Acres – Adjustment Review Page 5 of 9 <br />Written Statement May 19, 2026 <br /> <br /> <br /> <br />PART III – EUGENE CODE DEVELOPENT STANDARDS <br /> <br />Part III addresses compliance with applicable development standards in Eugene Code (EC). <br />Each applicable development standard is listed below in bold italics followed by findings <br />demonstrating compliance. <br /> <br />EC 9.5550(3) Adjustment. Except as provided otherwise in this section, the Middle <br />Housing Development Standards in EC 9.5550 may be adjusted consistent with the <br />criteria in EC 9.8030(37). <br />As allowed by this criterion, this Adjustment Review application has been respectfully submitted <br />to adjust the Middle Housing Development Standards at EC 9.5550(4)(a) to allow for a garage <br />and vehicular maneuvering areas between the existing residential building and the public street. <br /> <br />EC 9.5550(4) Standards for Triplexes and Fourplexes. Triplexes and fourplexes shall <br />comply with all of the following: <br />(a) Garages and Off-Street Parking Areas. Garages and off-street parking areas <br />shall not be located between a building and a public street, except in compliance <br />with the standards in subsections 1 or 2 below. <br />1. The garage or off-street parking area is separated from the front lot line <br />by a dwelling or a lot/parcel; or <br />No parking is permitted in the Child Lots 2 and 3 Access Aisle. As such, the <br />proposed garage and off-street parking area for Child Lot 1 is shown between the <br />existing dwelling and the front lot line as there is no other alternative for on-site <br />parking. As such, an adjustment has been requested, pursuant to EC 9.8030(37). <br /> <br />2. The combined width of all garages and outdoor on-site parking and <br />maneuvering areas does not exceed a total of 50 percent of the street <br />frontage (see Figure 9.5550(4)(a)2. Triplex/Fourplex Width of Garages and <br />Parking Areas). <br />As shown on the Site Plan, the proposed garage and outdoor on-site parking and <br />maneuvering areas exceed the maximum 50% of the street frontage. As such, an <br />adjustment has been requested, pursuant to EC 9.8030(37). <br /> <br />EC 9.8030 – Adjustment Review Approval Criteria <br /> <br />EC 9.8030(37) Middle Housing Standards Adjustment. Where EC 9.5550 provides that <br />standards applicable to triplexes, fourplexes, townhouses, or cottage clusters may be <br />adjusted, approval of the request shall be given if the applicant demonstrates <br />consistency with all of the following, as applicable: <br />(b) Garages, Off-Street Parking Areas, and Driveways for Triplexes and <br />Fourplexes. The requirements set forth in EC 9.5550(4)(a) and (b) may be adjusted <br />if the proposal achieves the following: <br />1. Supports a pedestrian-friendly street environment by minimizing the <br />visual and safety impacts of garages, parking areas, and vehicle circulation <br />areas. <br />The proposed accessory structure and off-street parking areas shown on the site <br />plan support a pedestrian-friendly street environment by minimizing the visual <br />and safety impacts of garages, parking areas, and vehicle circulation areas. <br />
