<br />310 Sunshine Acres – Adjustment Review Page 8 of 9 <br />Written Statement May 19, 2026 <br /> <br /> <br /> <br />The approved parking and circulation areas to benefit lots 2 and 3 will not be <br />altered as part of this request, and the visual and safety impacts are in <br />compliance with the standards of EC 9.5550(4) and 7.420(1) and (3). <br /> <br />2. Consistency with EC 9.8030(28). <br />Consistency with EC 9.8030(28) is addressed as follows: <br /> <br />EC 9.8030(28) Public Access Required. The public access requirement of 9.6735(2) may <br />be adjusted if the site developer demonstrates any of the following: <br /> <br />(b) The proposed adjustments to the standards will provide safe ingress and <br />egress to the development site, will not negatively impact the efficiency of the <br />public right-of-way, and will not result in a hazard to the bicycle, pedestrian or <br />vehicular traffic using the right-of-way. <br />The proposed access connection shown on the Site Plan complies with access <br />connection requirements at EC 7.420(1) and (3), ensuring a safe and efficient access <br />connection in the R-1 zone. This has been verified by Public Works Engineering Staff as <br />part of the due diligence process and no Adjustments are requested specific to those <br />standards. As shown on the Site Plan, the proposed compliant access approach width is <br />within the maximum 32 feet of access standard under EC 9.5550(4)(b)(5)(c)(1). <br /> <br />Therefore, the additional on-site vehicle maneuvering and parking areas exceeding 50% <br />of the lot frontage will have no additional negative impact to the public right-of-way. <br /> <br />(c) The proposed development will not impact one or more of the existing access <br />connections to the development site. Impact to an existing access connection <br />includes, but is not limited to, increasing the number of vehicles, either directly or <br />indirectly, that will utilize an existing access connection for ingress or egress to <br />the development site. <br />While (b) above has been adequately addressed to ensure compliance with EC <br />9.8030(28), it’s also relevant to note that no impacts are proposed to the existing access <br />connection serving Child Lots 2 and 3. <br /> <br />The addition of a new access connection to the north for Child Lot 1 will result in a net <br />equivalent or fewer vehicles utilizing the existing approved approach that provides <br />vehicular and pedestrian access to Child Lots 2 and 3 to the south and west. If the site <br />were strictly conforming to EC 9.5550(4)(a)(2), a proposed garage structure between the <br />building and the right-of-way would impact the southern connection by increasing the <br />number of vehicles entering and exiting the site through the existing or altered approach. <br />Again, the proposed location of the new access connection mitigates this potential <br />impact while remaining compliant with EC 7.420(1) and (3). <br /> <br />The placement of the proposed access connection to the north side of the property will <br />eliminate cross-aisle traffic conflicts for the existing access connection along the south <br />side off the property by locating the garage access to the north side of the structure. This <br />results in a positive impact to the existing access connection for both vehicles and <br />pedestrians by eliminating a potential conflict that would occur through strict adherence <br />to the Code. Further, the garage accessory structure would be permitted in the same <br />location if accessed from the current access, and poses no increase in sight line impacts <br />over that of a standard accessory structure in the same location, which is allowed <br />outright at the minimum 10-foot setback.
