<br />310 Sunshine Acres – Adjustment Review Page 7 of 9 <br />Written Statement May 19, 2026 <br /> <br /> <br /> <br /> <br />If the proposal were made to strictly conform to (a)(2) and minimum setback <br />requirements at EC Table 9.2750, a garage would be forced to utilize or expand <br />the existing southern approach and would result in insufficient turning radiuses, <br />structure depth, and would create cross-aisle maneuvering conflicts for both <br />pedestrians and vehicular traffic within the access easement for Child Lots 2 and <br />3. By locating the accessory structure and vehicle circulation areas for Child Lot <br />1 to the north side of the existing access connection, vehicular conflicts with <br />pedestrians accessing the child lots to the west, and the areas adjacent of the <br />abutting multi-use path, will be reduced. This contributes to a pedestrian-friendly <br />street environment by reducing the number of vehicles coming off the street and <br />into an enclosed structure through a single access connection, ultimately <br />reducing the negative impacts of garages, parking areas, and vehicle circulation <br />areas. <br /> <br />By eliminating access to the south side of the proposed structure, impacts to <br />users of the adjacent multi-use path may also be reduced by: eliminating <br />perpendicular bright headlights crossing the pedestrian right-of-way at short <br />lengths; eliminating backing movements that may contribute to a less safe <br />environment; eliminating tight turning radiuses in and out the proposed accessory <br />structure in close proximity to the adjacent pedestrian right-of-way; and, by <br />reducing the number of average daily trips for the southern pedestrian and <br />vehicular access connection serving Child Lots 2 and 3. Further, by physically <br />reducing the number of vehicles parking along the frontage with an additional <br />curb cut to the north, the southbound sight lines may be improved for the existing <br />multi-use path along the southern boundary of the site by creating a break in the <br />on-street parking availability, approximately 82 feet from the edge of the existing <br />pedestrian connection and approximately 60 feet from the pedestrian and <br />vehicular access connection benefitting Child Lots 2 and 3. <br /> <br />While parking is not required for the site, the proposed location of the garage <br />accessory structure and off-street parking area for the site is the only practical <br />on-site location available to store off-street vehicles (including bicycles), as the <br />southern portion of the Parent Lot is used for pedestrian access and <br />maneuvering of vehicles for the two rear child lots, and the setback requirements <br />at Table 9.2750 would prohibit an adequate garage design perpendicular to the <br />street. As noted above, no parking is allowed in the vehicular and pedestrian <br />access aisle for Child Lots 2 and 3. It's also important to reiterate that a single <br />unit dwelling residential garage accessory structure of the same size, in the same <br />zone, and on a smaller parcel would be permitted outright if meeting the <br />minimum driveway spacing of 18 feet. This scenario would be considered safe <br />and visually compliant if the proposal met the access standards at EC 7.420(1) <br />and (3).Therefore, the proposed layout would minimize visual or safety impacts <br />to the pedestrian environment similar to what is allowed outright for Single Unit <br />Dwellings in the same zone, as vehicle circulation would exit to the north, with <br />approximately 60 feet between access connections, mimicking that of a standard <br />single dwelling parcel of similar size and configuration. The two Triplex units to <br />the west provide compliant vehicular and pedestrian access via the “pole” portion <br />of the child lot that mimics a standard Flag Lot. <br />
