Tree Top Zone Change Page 5 of 10 <br />Map 18-03-04-23, Lot 01400 <br />May 11, 2026 <br /> <br /> <br /> <br />The Satre Group • 375 West 4th Avenue, Suite 201, Eugene, OR 97401 • (541) 686-4540 • www.satregroup.com <br />(4) Lot Standards containing lot area and dimension standards applicable in the particular S Special <br />Area zone. <br />(5) Siting Requirements in addition to those at EC9.8865 Zone Change Approval Criteria. <br /> <br />Response: This zone change application includes draft ordinance provisions establishing the <br />Purpose, Land Use and Permit Requirements, Development Standards, Lot Standards, and Siting <br />Requirements for the proposed S-Area Tree Top House Historic Zone. The submitted materials <br />demonstrate how each required component of EC 9.3030 is satisfied and how the proposed S - <br />Special Area zone is structured to ensure preservation of the historic resource while allowing for its <br />continued productive use. Detailed findings and supporting analysis are provided in the sections that <br />follow. <br /> <br />EC 9.8865 Zone Change Approval Criteria. Approval of a zone change application, including the <br />designation of an overlay zone, shall not be approved unless it meets all of the following criteria: <br /> <br />(1) The proposed change is consistent with applicable provisions of the Metro Plan. The written text of <br />the Metro Plan shall take precedence over the Metro Plan diagram where apparent conflicts or <br />inconsistencies exist. <br /> <br />Response: The subject property is designated Low-Density Residential under the Metro Plan and is <br />currently zoned R-1 (Low-Density Residential) under the City of Eugene Zoning Code. The proposed <br />S -Area Tree Top House Historic Zone would apply as a site-specific special area zone and would not <br />alter the underlying Metro Plan land use designation. <br /> <br />Several Metro Plan policies support historic preservation, neighborhood compatibility, and the <br />conservation of significant community resources. These policies are relevant to and supportive of the <br />proposed historic zoning, which is intended to ensure long-term preservation of the Tree Top House <br />while maintaining compatibility with the surrounding low-density residential neighborhood. <br /> <br />The Metro Plan does not establish mandatory approval criteria applicable to this request. The <br />proposed zone change does not amend the Metro Plan diagram or text. To the extent that applicable <br />policies are relevant, the proposed S -Area zone is consistent with those policies, as it preserves an <br />identified historic resource, maintains the residential character of the area, and reinforces the <br />community’s historic and cultural assets. <br /> <br />METRO PLAN DIAGRAM <br />The 2004 Metro Plan diagram designates the subject property as Low Density Residential. The Metro <br />Plan diagram does not illustrate base zones or overlay zones. <br /> <br />METRO PLAN TEXT <br />For those Metro Plan policies that are relevant, the proposed change will be consistent <br />with those policies, as described below. The following Metro Plan policies support the proposed zone <br />change in that: <br /> <br />Metro Plan Policy I.1: Adopt and implement historic preservation policies, regulations, and incentive <br />programs that encourage the inventory, preservation, and restoration of structures; landmarks, sites, <br />and areas of cultural, historic, or archaeological significance, consistent with overall policies." <br /> <br />• The requested zone change will facilitate the continued renovation, preservation, and long -term <br />protection of the Tree Top House, a designated historic resource. By enabling improvements <br />that support the structure’s viable use while maintaining its defining historic characteristics, the <br />proposal advances the intent of Policy I.1 to encourage preservation and restoration of culturally <br />and historically significant properties. Any future modifications will remain subject to applicable <br />historic preservation standards and review processes, thereby ensuring consistency with <br />adopted preservation regulations and the overall policies of the Metro Plan. <br />
