Therefore, <br />this criterion is not applicable. <br />> UTA 9.4640(l)(c) Approval of an expansion of an existing commercial or industrial development if <br />the proposed use will generate, singly or in the aggregate, a direct additional need for key urban <br />facilities and services provided by the city. <br />Findings: <br />As described above, the proposed development on tax lots 17-04-04-13-00100, 00200 & 00300 is <br />not new development, but it would be considered an expansion of the existing industrial <br />development. However, the scope of proposed work on these lots does not generate a direct need <br />for additional key urban facilities and services. Therefore, this criterion is not applicable. <br />Findings: <br />• 17-04-04-00-00100 & 00101: The proposed work on these lots is considered new industrial <br />development. The lots are under the same ownership and are considered a development site. <br />Since the lots are not contiguous to city limits and not eligible for annexation at this time, <br />Eugene Code (EC) 9.8117 allows the extension of water service and/or sewer service from inside <br />the city limits so long as the property owner executes an irrevocable consent to annexation <br />agreement approved by the city. <br />• 17-04-04-1300100, 00200 & 00300: These lots are currently development and therefore the <br />proposal does not include new commercial or industrial development on these lots. <br />• 17-04-04-42-00900 & 01000: The lots are proposed for redevelopment to accommodate <br />outdoor vehicle storage. As the lots area currently undeveloped, this is considered new <br />industrial development.
