April 17, 2026 Findings & Decision: ARA 26-1 Page 2 of 8 <br />are both under one ownership, creating a development site with two Middle Housing Triplexes <br />proposed, one on each lot. <br /> <br />The development site is surrounded by commercial development to the west, multi-unit <br />housing on property to the south, and abuts the public Right-of-Way of East 15th Avenue & High <br />Street to the east and north of this site. Tax Lot 06500 has two existing access connections on <br />East 15th Avenue that are proposed to be abandoned. Tax Lot 06501 has one existing access <br />connection on High Street that is proposed to be re-aligned to serve all six dwelling units on the <br />development site. <br /> <br />An Adjustment Review is a Type II land use application, and the approval criteria are found at <br />EC 9.8030. The relevant Type II land use application procedures are primarily addressed at <br />EC 9.7200 through EC 9.7230. The following evaluation includes a review of the applicant’s <br />proposed compliance with the applicable approval criteria and related standards. <br /> <br />For additional background information and details of the applicant’s proposal, please refer to <br />the applicant’s written statement and site plan within the application file. <br /> <br />Referrals/Public Notice <br />Upon deeming this application complete on March 4, 2026, the Planning Division provided <br />information concerning the application to other appropriate City departments, public agencies, <br />service providers, and the affected neighborhood group. The Planning Division also mailed <br />notice of the application on March 13, 2026, in accordance with the applicable requirements of <br />EC 9.7210. No public testimony was received within the open comment period. <br /> <br />Adjustment Review Evaluation <br />EC 9.8015 Adjustment Review – Purpose explains this process as encouraging design proposals <br />that respond to the intent of the code in an efficient and effective manner. EC <br />9.8020 Adjustment Review – Applicability confirms that this process is available only where the <br />land use code states that a specific standard may be adjusted. <br /> <br />The following evaluation includes a review of the applicant’s proposed compliance with the <br />applicable approval criteria and related standards. For additional background information and <br />details of the applicant’s proposal, please refer to the applicant’s written statement, <br />site plan and other supplemental information within the application file. <br /> <br />The applicant is requesting two adjustments. The first adjustment relates to the standards at EC <br />9.5550(4)(b)(5)(a) and the second adjustment request is related to the standards EC <br />9.5550(4)(b)(5)(b). <br /> <br />EC 9.5550(4)(b)(5) Lots or parcels with more than one frontage must comply with the <br />following: <br />a. Lots or parcels with frontages on major collectors and/or arterial streets must meet <br />the access connection standards applicable to major collectors and/or arterials <br />located in EC 7.420(2).
