Page 3 of 3 <br />(3) The final configuration of property lines shall not violate any previous <br />requirements or conditions of approval imposed with a prior applicable <br />land use decision. <br />No previous requirements or conditions of approval conflict with the <br />proposed property line adjustment. <br />(4) Public assessments, liens, and fees with respect to the partition have been <br />paid: <br />No public assessments, liens, or fees are due at this time. <br />(5) Within the /WR Water Resources Conservation Overlay Zone or /WQ Water <br />Quality Overlay Zone, no new lot may be created if more than 33% of the <br />lot, as created would be occupied by either: <br />(a) The combined area of the /WR conservation setback and any portion of <br />the Goal 5 Water Resource Site that extends landward beyond the <br />conservation setback; or <br />(b) The /WQ Management Area. <br />Tax lots 1900 and 2000 do not fall within the /WR Water Resources <br />Conservation Overlay Zone or /WQ Water Quality Overlay Zone. This <br />criterion does not apply. <br />(6) Within the R-1 zone in the city recognized boundaries of Amazon <br />Neighbors, Fairmount Neighbors, and South University Neighborhood <br />Association, property lines may only be adjusted up to 5 feet, measured <br />perpendicularly from the current location of the property line. A property <br />line under this section may be up to 10 feet if the adjustment is necessary <br />to accommodate an encroachment that existed as of April 12, 2014. <br />The property does not reside in any of the mentioned city recognized <br />boundaries; this criterion does not apply. <br /> <br />If any parcel or lot contains structures other then single-family residences, submit <br />additional information demonstrating that the adjusted line will not conflict with <br />applicable Uniform Building Code requirements. <br />The proposed property line adjustment has been evaluated for compliance with applicable <br />building code requirements and will not create any conflicts. The buildings adjacent to <br />the proposed property line are designed for zero-lot-line conditions. The building on <br />Property 1 was recently constructed under permit # 22-08319-01 and was evaluated for <br />compliance therein. A copy of the certificate of completion of said permit is attached for <br />reference. <br /> <br />
