3 - CONDITIONS OF APPROVAL COMPLIANCE <br /> <br />This section addresses compliance with the Conditions of Approval from Land Use File # MHT <br />25-35. Each applicable Condition of Approval is listed below in bold italics, followed by <br />statements addressing compliance. <br /> <br />1. The applicant shall submit an Irrevocable Petition for public improvements in Jackson <br />Street to include sidewalks. <br />The required Irrevocable Petition is included with this application. <br /> <br />2. The applicant shall submit an Irrevocable Petition for public improvements in Adams <br />Alley to include adequate paving width and storm drainage. <br />The required Irrevocable Petition is included with this application. <br /> <br />3. The applicant shall denote the pedestrian access easement connecting Lots (Parcels) <br />2 and 3 as the primary access for Lots (Parcels) 2 and 3 on the final site plans and <br />include the following note to the final site plans, "Prior to issuance of a certificate of <br />occupancy for the future dwelling on Lots (Parcels) 2 and 3, the pedestrian connection <br />between Lots (Parcels) 2 and 3 and Jackson Street shall be improved (e.g. paving, <br />pavers, or similar improved hard walking surface), establishing the pedestrian <br />connection as the primary access and the alley as secondary access." <br />On the final site plan, the pedestrian access easement has been noted as the primary access, <br />and the required note has been added to the Site Plan sheet. <br /> <br />4. Prior to final plat approval, the applicant will provide evidence that a separate water <br />service line is provided to Middle Housing Lots (Parcels) 2 and 3 outside the bounds of <br />Middle Housing Lot (Parcel) 1; or a private utility easement may be provided from Middle <br />Housing Lot (Parcel) 1 for the benefit of Middle Housing Lots (Parcels) 2 and 3. <br />Alternatively, the applicant may provide a deed restriction that holds the proposed <br />parcels under common ownership as one development site until such time as either the <br />separate water service line has been provided to Middle Housing Lots (Parcels) 2 and 3 <br />are outside the bounds of Middle Housing Lot (Parcel) 1, or that a private utility easement <br />has been provided and utilities located in the easement. <br />A private utility easement across Lot (Parcel) 1 for the benefit of Lots (Parcels) 2 and 3 is <br />included with this application. <br /> <br />5. Prior to final plat approval, the applicant will provide evidence that a separate <br />wastewater service line is provided to Middle Housing Lot (Parcel) 1, outside the bounds <br />of Middle Housing Lots (Parcels) 2 and 3; or a private utility easement may be provided <br />from Middle Housing Lots (Parcel) 2 and 3. Alternatively, the applicant may provide a <br />deed restriction that holds the proposed parcels under common ownership as one <br />development site until such time as either the separate wastewater service line has been <br />provided to Middle Housing Lot (Parcel) 1, or that a private utility easement has been <br />provided and utilities located in the easement. <br />A 5-foot-wide private utility easement across Lots (Parcels) 2 and 3 for the benefit of Lot <br />(Parcel) 1 is included with this application. This is intended to provide wastewater service to Lot <br />(Parcel) 1 via an already-constructed wastewater line. <br /> <br />6. Prior to final plat approval, the applicant will provide evidence that separate electrical <br />service is outside the bounds of Middle Housing Lots (Parcels) 2 and 3; or an EWEB <br />easement may be provided to serve Middle Housing Lots (Parcels) 1, 2 and 3. <br />Middle Housing Land Division, Final Plat - Written Statement Page 3 of 4
