Metro Planning, Inc Middle Housing Tentative Partition for Cunningham Trust January 2025 <br />EC 9.8194 — Middle Housing Land Division, Tentative Plan Approval Criteria. <br />The planning director shall approve, conditionally approve, or deny the middle housing land division tentative plan <br />application based on compliance with the following criteria: <br />(1) If the property to be divided is not yet developed with middle housing: <br />(a) The application proposes development of middle housing on the lot or parcel to be divided; and <br />(b) The lot or parcel orbe divided is developable with middle housing consistent with the following: <br />1. EC 9,2750; <br />2. EC 9,2751; <br />3. EC 9,2760; <br />4. EC 9,2761; <br />5. EC 9,2775; and <br />6. EC 9,5550, <br />Response: The subject property is already developed with middle housing. There is an existing detached duplex on the subject <br />property. The proposed middle housing partition will effectively result in one dwelling unit on each new middle housing lot. No additional <br />development is proposed with this application. EC 9,8194(1) is not applicable to this proposal. <br />(2) If the property to be divided is developed with middle housing: <br />(a) The middle housing complies with EC 9.5550; or <br />(b) The certificate of occupancy for the middle housing was issued before June 30, 2022, and the middle housing <br />complied with applicable land use requirements at the time the certificate of occupancy was issued. <br />Response: In compliance with EC 9,8194(2)(a), the subject property to be divided was developed with middle housing prior to June 30, <br />2022, The dwelling fronting W 1511, Avenue (Dwelling 1) was effectively built in 1956; inspected by the City of Eugene in 1993. The <br />dwelling on Chambers Alley (Dwelling 2) was effectively built in 1974; inspected by the City of Eugene in 1993. <br />See the attached RLID reports. Additionally, the existing detached duplex complies with EC 9,5550; applicable standards addressed <br />below. <br />EC 9,5550 — Middle Housing Development Standards. <br />(1) Purpose of Middle Housing Development Standards. The purpose of these development standards is to: <br />(a) Ensure that new middle housing development enhances the variety of housing options available to Eugene's <br />residen ts; <br />(b) Ensure consistency with state requirements for middle housing; <br />(c) Promote development of middle housing that provides opportunities for both rental and ownership housing; <br />(d) Provide an adequate supply and range of housing types and prices that will meet the city's future population <br />growth; <br />(e) Promote building and site design that contributes positively to a sense of neighborhood and to the overall <br />streetscape; and <br />(0 Provide a physical environment that contributes to and enhances the quality of life. <br />Response: This middle housing land division intends to fulfill the standards and objectives enumerated in (a)-(f), above. Partitioning the <br />subject property, effectively resulting in one individual dwelling unit located on its own lot, creates rental and more specifically ownership <br />opportunities that were not previously possible and enhances the variety of housing options available in the neighborhood without the <br />Page12 <br />
