Metro Planning, Inc Middle Housing Tentative Partition for Cunningham Trust January 2025 <br />need for additional urban development. This proposal embodies the intentions of the middle housing development standards detailed <br />above. <br />(2) Applicability of Middle Housing Development Standards. <br />(a) Except as provided In subsection (b), Middle Housing Development Standards In this section 9.5550 apply <br />to: <br />1. The development of all new middle housing, excluding duplexes; and <br />2. The development of middle housing, excluding duplexes, on a site with an existing dwelling or <br />dwellings; and <br />3. The development of middle housing, excluding duplexes, created by adding building area to an <br />existing dwelling or dwellings. <br />(b) Except as provided at EC 9.5550(6)(g), the Middle Housing Development Standards do not apply to <br />existing dwellings, buildings, and structures that are not being altered as part of the middle housing <br />development. <br />Response: Per EC 9.5550(2), Middle Housing Development Standards do not apply to this application as they do not apply to duplexes <br />or to dwellings that are not being altered as part of a middle housing land division. The subject property to be divided for middle <br />housing is already developed with a detached duplex; neither of the dwelling units of the detached duplex require additional <br />development. EC 9.5550(6)(g) is not applicable to this proposal as It contains standards related to cottage cluster housing only. <br />In sum, the existing detached duplex dwelling units are not being altered as part of this middle housing land division which renders <br />them exempt from the middle housing development standards contained in EC 9,5550, This two -lot middle housing tentative partition <br />proposal complies with EC 9.5550 and 9.8194(2). <br />EC 9.8194 — Middle Housing Land Division, Tentative Plan Approval Criteria (cont'd). <br />(3) The proposed middle housing land division complies with all of the following: <br />(a) EC 9.2777, Middle Housing Lot standards; <br />Response: There are no frontage, width, or lot area standards for middle housing lots. As required, there is only one unit of middle <br />housing located on each proposed middle housing lot and the parent parcel being divided is not a middle housing lot. <br />These criteria are met. <br />(b) EC 9.6505, Improvements, Specifications for any street frontage improvements required for middle housing on <br />lots that abut a street; <br />Response: No improvements per EC 9.6505 are required for the proposed middle housing partition. All improvements are existing. <br />This criterion is satisfied. <br />(c) EC 9.6805, Dedication of Public Ways; and <br />Response: There are no public ways required to be dedicated to the City of Eugene. This criterion is satisfied. <br />(d) All other applicable development standards for features explicitly included in the application. <br />Response: All development is complete; no new development is proposed. There are no other applicable development standards than <br />the standards addressed in this written narrative. This criterion is satisfied. <br />Page 13 <br />
