Streets, Sidewalks, Bikeways and Accessways and standards and specifications adopted <br />pursuant to Chapter 7 of this code and other adopted plans and policies. The specifications <br />required by this code for streets and alleys are satisfied as they pertain to the proposed 2- <br />parcel partition of the subject property. <br /> <br /> <br />5) Bicycle Paths and Accessways <br /> <br />Response: No streets or bicycle lanes are proposed as part of this partition application. This <br />criterion is not applicable. <br /> <br />d) EC 9.6706 Development in Flood Plains through EC 9.6709 Special Flood Hazard Areas – <br />Standards <br /> <br />Response: Per FIRM Map Number 41039C1109F, Community Number 039C, the subject <br />property is located in Zone X, an area determined to be outside of the 500-year floodplain. <br />The standards and criteria contained in EC 9.6706 – 9.6709 pertaining to development in <br />Flood Plains and Special Flood Hazard Areas do not apply to the proposed partitioning of the <br />subject property. <br /> <br />e) EC 9.6710 Geological and Geotechnical Analysis <br /> <br />9.6710 – Geological and Geotechnical Analysis. <br /> <br />1) Purpose of Geological and Geotechnical Analyses. The purpose of geological and geotechnical <br />analyses is to ensure that public and private facilities in developments in areas of known or potential <br />unstable soil conditions are located, designed, and constructed in a manner that provides for public <br />health, safety, and welfare. <br />2) Geological and Geotechnical Analysis Required. Except for those activities exempted under EC <br />9.6710(3) Exemptions from Geological and Geotechnical Requirements, a geological and <br />geotechnical analysis, prepared by an Oregon licensed Engineering Geologist or an Oregon <br />licensed Civil Engineer with geotechnical experience, conforming with standards, procedures and <br />content as defined in the Standards for Geological and Geotechnical Analysis adopted by the city in <br />the manner set forth in EC 2.019 City Manager – Administrative and Rulemaking Authority and <br />Procedures, is required for any of the following: <br />a) All proposed tentative planned unit development, site review, or subdivision applications on <br />properties with slopes equal to or greater than 5%. <br />b) All proposed development that includes dedication or construction of a public street or alley or the <br />construction of public drainage systems or public wastewater sewers. <br /> <br />Response: Subsections (2)(a) does not apply to this proposed 2-parcel tentative partition. Per <br />Subsection (2)(b), a Geological and Geotechnical Analysis is not required for the proposed <br />partition as dedication or construction of a public street or alley, or the construction of public <br />drainage systems of public wastewater sewers is not proposed nor required. Additionally, <br />criteria contained in EC 9.6710 (3)-(6) do not apply to this proposal. <br /> <br />f) EC 9.6735 Public Access Required <br /> <br />9.6735 – Public Access Required. <br />1) Except as otherwise provided in this land use code, no building or structure shall be erected or <br />altered except on a lot fronting or abutting on a public street or having access to a public street over <br />a private street or easement of record approved in accordance with provisions contained in this land <br />use code.
