9.6500 – Easements. <br /> <br />(1) The city may require the dedication of easements for wastewater sewers and other public <br />utilities, and for access thereto for maintenance, of a sufficient width to meet the intended use, <br />provided the city makes findings to demonstrate consistency with constitutional requirements. <br /> <br />Response: There are existing wastewater and stormwater lines in Kourt Dr.; there are no <br />existing easements for access to or maintenance of these or other public utilities that may be <br />located in Kourt Dr. Should the city require the dedication of easements for public utility <br />access or maintenance with this partition plat, the property owner will comply providing the <br />City is able to demonstrate consistency with constitutional requirements. <br /> <br />2) Easements may be required along lot or parcel rear lines or side lines, or elsewhere as <br />necessary to provide needed facilities for present or future development of the area. <br /> <br />Response: Noted. <br /> <br />3) No building, structure, tree, or other obstruction shall be placed or located on or in a public <br />utility easement. Prior to approval of a final PUD, final site review plans, or final plats, there shall <br />appear thereon a restriction showing compliance with this subsection. <br /> <br />Response: There are no existing public utility easements adjacent to the subject property. <br /> <br />9.6505 Improvements – Specifications. <br /> <br />1) Water Supply. All developments shall be served by the water system of the Eugene Water & <br />Electric Board. <br /> <br />Response: Water utility service is existing to the subject property and provided by the <br />Eugene Water and Electric Board according to their policies and procedures. <br /> <br />2) Sewage. All developments shall be served by the wastewater sewage system of the city, <br />complying with provisions in Chapter 6 of this code. <br /> <br />Response: There is existing wastewater sewer line within Kourt Dr. that serves the subject <br />property, complying with provision in Chapter 6 of this code. <br /> <br />3) Streets and Alleys <br /> <br />Response: Kourt Dr. at the subject property meets the right-of-way and paving widths <br />identified in EC 9.6870.Kourt Dr. is an unimproved street and the property owner shall sign an <br />irrevocable petition for future improvements to include bicycle accessways, sidewalks, <br />curbs, gutters, street trees and street lights designed according to the Design Standards and <br />Guidelines for Eugene Streets, Sidewalks, Bikeways and Accessways and standards and <br />specifications adopted pursuant to Chapter 7 of this code and other adopted plans and <br />policies. The specifications required by this code for streets and alleys are satisfied as they <br />pertain to the proposed 2-parcel partition of the subject property. <br /> <br />4) Sidewalks <br /> <br />Response: Kourt Dr. is an unimproved street and the property owner shall sign an <br />irrevocable petition for future improvements to include sidewalks, curbs, gutters, street trees <br />and street lights designed according to the Design Standards and Guidelines for Eugene
