code or specified in adopted plans. Subject to EC 9.4980 /WR Water Resources <br />Conservation Overlay Zone Development Standards (1) through (11). <br />The above code section allows for the applicant to apply for a Standards Review approval for <br />the construction of a public street through the Standards Review process. The applicant's <br />submitted materials also indicate that their proposal includes several other uses subject to <br />standard review; the construction of new underground utility lines, restoration of impacted <br />conservation areas and construction of stormwater facilities. The public improvements are <br />associated with public streets which were required as part of their approved Tentative Planned <br />Unit Development, in accordance with the land use code. As such, this proposal includes public <br />improvements required by the land use code, consistent with EC 9.4930(3)(b). It is worth noting <br />that the code section above requires a review of all development standards for the /WR overlay <br />zone. With a wide scope, and improvements required by the land use code, staff believes that it <br />is appropriate for the applicant to seek approval for the public street, private utilities, <br />restoration of impacted conservation areas and construction of stormwater facilities under EC <br />9.4930(3). <br />The proposed extension of Randy Lane impacts one conservation area in the southern portion <br />of the site where Videra Creek crosses the site and is channeled into an existing underground <br />12-inch storm drain that empties into abutting Videra Park southeast of the site. The street, <br />utility and storm drainage construction will occur over the area where the existing drainage <br />pipe is buried. No alteration or construction will occur within the above ground portion of the <br />creek located on the site. <br />Based on the available information, the proposed project is subject to approval of a standards <br />review in accordance with EC 9.8470 and the /WR Water Resource Conservation Overlay Zone <br />development standards EC 9.4980(1) through (11), which are provided below (in bolded text) <br />followed by findings. <br />EC 9.8470 Standards Review Approval Criteria <br />The decision -maker shall determine whether the application is in compliance with the <br />standards setout in the code section that calls for standards review. <br />In this case, as noted above, the proposed project is subject to the /WR Water Resource <br />Conservation Overlay Zone Development Standards EC 9.4980(1) through (11), which are <br />provided below (in bolded text) followed by findings. <br />EC 9.4980 /WR Water Resources Conservation Overlay Zone Development Standards <br />(1) Enhancement.
