Middle Housing Land Division, however, the applicant has applied for building permits for the
fourplex simultaneously with this land division.
The subject property abuts Alder Street to the west and East 22nd Street to the north.
Proposed Middle Housing Lot 1 is 1,800 square feet; Middle Housing Lot 2 is 913.5 square feet;
Middle Housing Lot 3 is 1,085 square feet; and Middle Housing Lot 4 is 1,343 square feet.
Adjacent properties are developed with residential units.
Additional details of the proposal are included in the applicant's written statement and
supporting documentation, all of which are included as part of the public record and located in
the application file for reference.
What is a Middle Housing Land Division: A Middle Housing Land Division is a process to create
Middle Housing Lots, each of which contains a single unit of middle housing within a middle
housing development (e.g. one dwelling unit in a fourplex). This allows for the sale of individual
units in a Middle Housing development, which will serve to expand home ownership
opportunities. A Middle Housing Land Division can occur before, during, or after the
construction of the middle housing itself. In this case, middle housing has not yet been
developed, as there is only one existing single -unit dwelling on the subject property. Any
Middle Housing developed in Eugene must be constructed in accordance with the applicable
development standards.
A Note on Terminology: Eugene Code Section 9.0500, Definitions, defines a "Middle Housing
Lot" as "A lot or parcel created through a middle housing land division." Middle Housing Land
Division is the only codified process through which Middle Housing Lots can be created.
However, for platting purposes, two different terms, "lot" and "parcel," are used, depending on
the number of lots proposed. The term "lot" is used when units of land are created through the
Subdivision process, which is used to create four or more units of land. The term "parcel" is
used when units of land are created through the Partition process, which is used to create three
or fewer units of land.
In this case, the proposal will result in four Middle Housing Lots, which for platting purposes will
be referred to as "lots" on the final plat. For consistency throughout this decision, the term
Middle Housing Lot" is synonymous with "middle housing parcel," and the terms are used
interchangeably in the context of this Decision.
Public Notice and Referrals
In accordance with House Bill 2138, if requested by the applicant, an application for Middle
Housing Land Division may be processed in accordance with the expedited land division
procedures in state law. In this case, the applicant has requested review of this Middle Housing
Land Division application subject to the amended Expedited Land Division procedures of ORS
197.365, as amended by House Bill 2138. Pursuant to House Bill 2138, this decision may only be
appealed by the applicant. Appeals to Expedited Land Division determinations are subject to
the amended provisions of ORS 197.830 to 197.855, as amended by House Bill 2138.
