2/20/2026 <br /> <br />2 <br />II. Standards Review (SDR 25-02) <br /> <br />Condition 18 of the Order requires a Standards Review approval for the proposed public street <br />expansion of Randy Lane within the protected Water Resources Conservation Area (/WR), subject to the <br />standards at EC 9.4900-9.4980. Here, the Applicant has failed to demonstrate compliance with multiple <br />applicable provisions for the /WR, thus, the application for the SDR must be denied. <br />A. The Applicant has not demonstrated compliance with EC 9.4920 <br />The subject property includes a designated Category C stream and a Category B wetland that is at issue <br />with this SDR application. Accordingly, compliance with provisions involving the stream and wetland must be <br />demonstrated by the Applicant for approval. Here, neither has occurred. <br />i. EC 9.4920(2)(b) <br />EC 9.4920(2)(b) provides: <br />“The area within the applicable conservation setback. The conservation setback for a particular <br />site is determined based on whether it is a Category A, B or C wetland in the Goal 5 Water <br />Resources Conservation Plan. Conservation setback distances for wetlands are measured <br />horizontally from wetland boundaries established under the “Goal 5 Locally Significant Wetland <br />Sites Within the Eugene Urban Growth Boundary” map or if provided by the property owner, from <br />the jurisdictional wetland boundary accepted by the Oregon Department of State Lands. <br />Conservation setback distances are as follows: <br /> <br />Resource Conservation Setback <br />Category A Wetland 50 feet <br />Category B Wetland 25 feet <br />Category C Wetland no conservation setback” <br /> <br />The Applicant provided a jurisdictional wetland boundary map which was accepted by the Oregon <br />Department of State Lands. On that map, the wetland boundaries for Wetland 2b (entirely a designated water of <br />the US) are clearly demarcated. The Site Plan provided by the Applicant shows that the required 25-foot <br />setback, for the designated Category B wetland, fails to follow the entirety of Wetland 2b (Wetland 2b clearly <br />extends past the proposed setback indicated on the Site Plan) into Lots 27, 31, and 32. Additionally, the <br />required Category B wetland setback does not extend 25 feet from the boundary of the wetland into Lots 24, 31, <br />32, 33, 34, and 38.
