2/20/2026

2
II. Standards Review (SDR 25-02)

Condition 18 of the Order requires a Standards Review approval for the proposed public street
expansion of Randy Lane within the protected Water Resources Conservation Area (/WR), subject to the
standards at EC 9.4900-9.4980. Here, the Applicant has failed to demonstrate compliance with multiple
applicable provisions for the /WR, thus, the application for the SDR must be denied.
A. The Applicant has not demonstrated compliance with EC 9.4920
The subject property includes a designated Category C stream and a Category B wetland that is at issue
with this SDR application. Accordingly, compliance with provisions involving the stream and wetland must be
demonstrated by the Applicant for approval. Here, neither has occurred.
i. EC 9.4920(2)(b)
EC 9.4920(2)(b) provides:
“The area within the applicable conservation setback. The conservation setback for a particular
site is determined based on whether it is a Category A, B or C wetland in the Goal 5 Water
Resources Conservation Plan. Conservation setback distances for wetlands are measured
horizontally from wetland boundaries established under the “Goal 5 Locally Significant Wetland
Sites Within the Eugene Urban Growth Boundary” map or if provided by the property owner, from
the jurisdictional wetland boundary accepted by the Oregon Department of State Lands.
Conservation setback distances are as follows:

Resource Conservation Setback
Category A Wetland 50 feet
Category B Wetland 25 feet
Category C Wetland no conservation setback”

The Applicant provided a jurisdictional wetland boundary map which was accepted by the Oregon
Department of State Lands. On that map, the wetland boundaries for Wetland 2b (entirely a designated water of
the US) are clearly demarcated. The Site Plan provided by the Applicant shows that the required 25-foot
setback, for the designated Category B wetland, fails to follow the entirety of Wetland 2b (Wetland 2b clearly
extends past the proposed setback indicated on the Site Plan) into Lots 27, 31, and 32. Additionally, the
required Category B wetland setback does not extend 25 feet from the boundary of the wetland into Lots 24, 31,
32, 33, 34, and 38.
