PDT 25-01/ST 25-02. The Applicant has failed to carry their burden <br />of proving compliance with the all of the applicable provisions. <br />For the following reasons, these applications for a final PUD and the standards review should be denied. <br /> <br />I. Final Planned Unit Development (PDF 25-01) <br /> <br />The Conditions of Approval for this Final PUD were described in the Final Order of the Eugene <br />Planning Commission approving the Tentative PUD for the subject property (“Order”). The application <br />materials are insufficient to demonstrate compliance with at least one of the required Conditions of Approval. <br />Condition of Approval 11 states: “Prior to final plat approval, the applicant shall provide documentation <br />that EWEB has received a financial guarantee, ensuring water will be provided to each lot in the plat.” <br />The Applicant responds: “Acknowledged and agreed.” Final PUD, p. 4. <br />“Acknowledged and agreed” is insufficient to demonstrate compliance with the condition of approval as <br />it is a vague assertion without the required documentation which is expressly required by the provision. <br />Therefore, the Applicant has not carried their burden of proof and demonstrated compliance with all of <br />the required conditions of approval, and the Final PUD should be denied. <br />
