Learn why this is important <br />[EXTERNAL ] <br />Dear Mr. Gioello, <br />I am requesting denial of PDF 25-01 and SDR 25-02 because the applicant has notdemonstrated conformity with EC 9.8365 and has left substantial compliance gaps inenvironmental protections. <br />First, regarding the Final Planned Unit Development: <br />EC 9.8365 requires that the Final PUD conform to the approved Tentative PUD and all <br />attached conditions. The Joint Access & Maintenance Agreement (JAM), introduced atthe final stage, materially affects how the development will function. <br />Most of the 37 lots rely on shared driveways serving two to five properties. Thatcould mean: <br />4–10+ vehicles per driveway for single-family homes, <br />Significantly more if multi-unit housing is built. <br />Driveways are described as 14 feet wide or of “variable width.” Fourteen feet is <br />insufficient for two standard SUVs or trucks to pass safely. “Variable width” is not a <br />defined engineering standard. <br />The JAM assigns driveway and utility maintenance responsibilities to specific futurelot owners (Lots 5, 7, 10, 21, 31, 32, 33). These are substantial infrastructureobligations typically managed by public entities or structured associations, notindividual homeowners. <br />Questions that remain unanswered: <br />How will emergency vehicles access lots during peak congestion? <br />How will snow removal be coordinated? <br />What happens if the designated responsible lot does not sell? <br />What enforcement mechanism exists if maintenance lapses? <br />If these operational realities differ from the expectations under the Tentative PUD,the Final PUD may not conform under EC 9.8365. <br />Second, under EC 9.4920(3), the applicant has not properly mapped the combinedconservation footprint of the Category B wetland and Category C stream. Without the <br />combined footprint, compliance cannot be confirmed.
