651 West 23rd Avenue (MHT 25-36) Page 5 of 5
Conditions of Approval
February 27, 2026

Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108
Landscape Architecture + Land Use Planning
the installation of water facilities (services & hydrants) at common lot corners. A minimum 5’ wide “utility
corridor” at service crossing and hydrant locations is required. State Drinking Water regulations (OAR
333-061-0050(10)) require a minimum separation between water and sewer lines of 10’ where they run
parallel to each other, unless the sewer line is located with 1.5’ of clearance lower than the water line then
the required separation is 5’. EWEB owned water facilities will be located in the right-of-way, or in a
minimum 7’ public utility easement (PUE) adjacent to the public right-of-way, or in a minimum 14’ PUE
when not adjacent to public right-of-way.

Water comments or questions can be directed to:

Bill Johnson
Water Engineering Technician IV
Eugene Water & Electric Board
Office/fax 541-685-7377; bill.johnsonr@eweb.org

Right-of-Way Comments
Easements must be either Public Utility Easements or EWEB Easements if they are to accommodate
EWEB facilities. A PUE or EWEB Easement is required for the proposed overhead lines crossing
proposed Parcel 1 that serve proposed Parcel 2 and 3, unless those lines are relocated prior to
recordation of the final plat. A PUE or EWEB Easement is also required for the proposed water line
crossing proposed Parcel 1 that serve proposed Parcel 3.
A Deed Restriction is being submitted that ensures the parcels are held in common ownership until the
electric line is relocated into the proposed PUE. Recording of the Final Plat is not dependent on m oving
that electric line.

Because a Public Utility Easement is designated on the plat, the plat should include the customary note
for PUE’s: “No building, structure, trees, shrubbery or other obstruction shall be placed or located on or in
a public utility easement.”
This note has been added to the Final Plat.

If an EWEB Easement is designated on the plat, a separate EWEB Easement document will need to be
created by EWEB Property Management. This document will be recorded with the Plat. IN addition, if an
EWEB Easement is designated on the plat, EWEB requests that a Note be added to the plat stating:
“EWEB easements shall include EWEB and its joint users with whom it may contract. At no time shall any
building, structure, sign or other obstruction shall be erected or placed or located within an EWEB utility
easement area without prior written consent of EWEB.”
A PUE, not an EWEB Easement is designated on the Final Plat.

Right-of-way comments or questions can be directed to:

Isabelle Mattews
Right-of-Way Agent
Eugene Water & Electric Board
Office/fax 541-685-7041; Isabelle.mathews@eweb.org

Please call if you have any questions, comments or need any additional information. I believe this
completes all conditions of approval.

Sincerely,
Schirmer Consulting, LLC

Carol Schirmer
