East Campus University of Oregon (CA 25-02, RA 25-01, Z 25-03) <br />Findings Page 19 of 36February 2026 <br /> <br /> <br />Envision Eugene Comprehensive Plan <br />There are no policies in the local comprehensive plan that appear to be directly relevant to this <br />amendment or that serve as mandatory approval criteria for the amendment. <br />The Envision Eugene Housing Needs Analysis adopted in 2017 notes on page 70 that “[s]tudent <br />housing preferences can have an important impact on demand for housing in Eugene. Students <br />at the University of Oregon accounted for about 16% of Eugene’s population in 2011, based on <br />University enrollment data.” The Council finds this to be relevant context to its policy decisions <br />in this proceeding. <br />EC 9.8424(1)(c) Remaining portions of the refinement plan. <br />The Fairmount/University of Oregon Special Area Study provides policy direction related to land <br />use, transportation, and parking, to guide development within the eastern portion of the <br />University of Oregon campus and the adjacent portion of the Fairmount Neighborhood. The <br />Fairmount/University of Oregon Special Area Study, which was adopted in 1982, recognizes the <br />need for periodic updates to the plan. The text on page 6 of the Refinement Plan states: “This <br />plan is a long-range, comprehensive plan and, as such, should be occasionally reviewed and <br />updated (the University Development Policy specifically states it should govern for ten years <br />from the date of its acceptance). Changes in conditions may dictate reconsideration of policies .” <br />The Refinement Plan Amendment includes updates to several sections of the <br />Fairmount/University of Oregon Special Area Study. As is stated at the beginning of this <br />evaluation, many of the Refinement Plan text updates will not constitute substantive changes to <br />the Plan. Rather, a number of changes are for the purpose of updating outdated terms and <br />references, as well as providing for modern planning efforts and outcomes. <br />The most significant of the diagram and text amendments are primarily applicable to the area <br />designated as Limited High Density Residential / Limited Institutional (LHDR/LI). In order to <br />update the Refinement Plan to align with the University’s current and future housing needs, the <br />exclusion of dormitory uses is removed from the section of the Land Use Diagram text that <br />describes the LHDR/LI area. <br />Remaining portions of the Fairmount/University of Oregon Special Area Study relate to areas <br />outside the East Campus boundaries or to general neighborhood policies, none of which will be <br />directly affected by the Refinement Plan Amendment. As such, no polices listed in the Study <br />appear to serve as mandatory approval criteria for this amendment or require further analysis <br />beyond that provided above. Based on the above findings, the Council finds that the <br />Refinement Plan Amendment is consistent with the remaining portions of the <br />Fairmount/University of Oregon Special Area Study. This criterion is met. <br />Response to opponents’ consistency arguments <br />FNA argues that the University’s proposed changes to the refinement plan are inconsistent with <br />the remaining portions of the plan and therefore violate EC 9.8424(1)(c). This section of the <br />findings identifies and responses to FNA’s arguments concerning EC 9.8424(1)(c).
