East Campus University of Oregon (CA 25-02, RA 25-01, Z 25-03) <br />Findings Page 6 of 36February 2026 <br /> <br /> <br />The Council also finds that the modified proposal remains consistent with public notices <br />provided by the City to the local public and the Department of Land Conservation and <br />Development (DLCD) regarding this land use proceeding. The notice to DLCD described the <br />University’s proposal as follows: <br />“Applicant’s Proposal: The University of Oregon, the applicant, <br />has requested a Refinement Plan Amendment, Code Amendment <br />and Zone Change. The requested Refinement Plan Amendment <br />would update the Fairmount/University of Oregon Special Area <br />Study for consistency with the University of Oregon’s newly <br />updated East Campus Area Plan and redesignate certain <br />properties to “Institutional”. The proposed Code Amendment <br />would change the East Campus Overlay Zone (/EC) to include <br />residence halls as a permitted use, increase the maximum height <br />limit, and update the residential transition area. The proposed <br />Zone Change would remove the /EC East Campus Overlay Zone <br />from nine properties that are currently developed with <br />institutional uses.” <br />The above notice language is nearly identical to the language in the local public notice. This <br />language applies equally to the modified proposal approved by the Council. The Council <br />therefore finds that the City’s notices served their intended function of informing the public of <br />the nature of the University’s proposal and allowing for broad public participation in this <br />proceeding. The modifications adopted by the Council are not incongruous with the proposal <br />noticed by the City. <br />Findings regarding applicable criteria <br />The applications for a Refinement Plan Amendment, Code Amendment, and Zone Change were <br />processed concurrently, pursuant to EC 9.8005. The following findings address the proposal and <br />the applicable approval criteria at EC 9.8424, EC 9.8065, and EC 9.8865. Those criteria are <br />provided below (in bolded text), including findings addressing compliance with each. <br />REFINEMENT PLAN AMENDMENT <br />EC 9.8424(1) The refinement plan amendment is consistent with all of the following: <br />EC 9.8424(1)(a) Statewide planning goals. <br />Goal 1: Citizen Involvement - To develop a citizen involvement program that <br />ensures the opportunity for citizens to be involved in all phases of the planning <br />process. <br />The City has acknowledged procedures for adoption of quasi-judicial land use decisions, located <br />in EC 9.7050, 9.7400 through 9.7455, and 9.7065 through 9.7095, which ensure the opportunity <br />for community members to be involved in all phases of the quasi-judicial land use decision <br />process and set out the requirements for such involvement. The amendments to the <br />Fairmount/University of Oregon Special Area Study do not amend the City’s adopted citizen
