Middle Housing Land Division – Replat of P3 of LPPN 2025 – P3284 <br />Metro Planning, Inc February 2026 5 | P a g e <br /> <br />at least 25 feet; the Variable Width Joint Use Access & Utility Easement proposed on the northern side of the subject property will <br />be paved to at least 20 feet. <br /> <br /> <br /> <br />EC 9.2777 Middle Housing Lot Standards. <br /> <br />(1) There are no frontage, width, or lot area standards for middle housing lots. <br /> <br />There are no frontage, width, or lot area standards for the new proposed middle housing lots. However, the subject property (P3 of <br />LPPN 2025-P3284) must, and does, comply with R-1 lot standards and criteria contained in EC 9.2760-9.2761, addressed herein <br />on pages 2 and 3. <br /> <br />(2) A middle housing lot may not contain more than one unit of middle housing. A middle housing lot that includes a <br />common area, but does not include a dwelling, is permitted. <br /> <br />The three (3) middle housing lots proposed for development with this middle housing land division application will not contain more <br />than one dwelling unit each. This proposal complies with EC 9.2777(2). <br /> <br />(3) A middle housing lot may not be divided. <br /> <br />The three (3) middle housing lots proposed for development with this middle housing land division application will not be further <br />divided. The proposal complies with EC 9.2777(3). <br /> <br /> <br /> <br />EC 9.5550 Middle Housing Development Standards. <br /> <br />(2) Applicability of Middle Housing Development Standards. <br /> <br />(a) Except as provided in subsection (b), Middle Housing Development Standards in this section 9.5550 apply to: <br /> <br />1. The development of all new middle housing, excluding duplexes; and <br />2. The development of middle housing, excluding duplexes, on a site with an existing dwelling or <br /> dwellings; and <br />3. The development of middle housing, excluding duplexes, created by adding building area to an <br /> existing dwelling or dwellings. <br /> <br />There are no dwellings proposed at this time. <br /> <br /> (b) Except as provided at EC 9.5550(6)(g), the Middle Housing Development Standards do not apply to existing <br /> dwellings, buildings, and structures that are not being altered as part of the middle housing development. <br /> <br />There are no existing dwellings, buildings, or structures on the subject property and EC 9.5550(6)(g) applies to cottage clusters; this <br />criterion is not applicable. <br /> <br /> (c) The Middle Housing Development Standards do not apply to middle housing conversion. <br /> <br />There are no existing dwellings; this criterion does not apply. <br /> <br /> (d) The Middle Housing Development Standards shall apply in all zones. <br /> <br />The subject property is zoned R-1 where middle housing development standards apply. <br /> <br />
