City of Eugene <br />Adjustment Review Application <br />February 4, 2026 <br />Page 2 of 7 <br /> <br /> <br /> <br />The Applicant submitted a separate Final Plat Partition application that demonstrates consistency with <br />the approved Tentative Plan Partition, which results in the current parcel being divided into two legal, <br />buildable lots (Parcel 1 and Parcel 2 - see attached Final Plat Partition for reference only). The Applicant <br />also submitted a separate SB 1537 Adjustment Review application. One plan set has been submitted for <br />both the subject City Adjustment Review application and the SB 1537 Adjustment Review application. <br /> <br />As noted above, the Applicant acknowledges that the proposed design as presented in City Adjustment <br />Review and SB 1537 Adjustment Review applications, is contingent upon approval of the Final Plat <br />Partition creating the two proposed lots. Therefore, the applicant proposes the following draft Condition of <br />Approval in both adjustment review applications: <br /> <br />Prior to building permit approval and commencement of site improvements for the proposed <br />project on Parcel 2, the associated separate Final Partition Plat application shall be approved <br />at the local level. <br /> <br />The applicant requests an adjustment to the following section of the Eugene Code. <br /> <br />• EC 9.5500(6)(a) – Neither the maximum length nor width of any building within 40 feet of a <br />front lot line can exceed … 150 feet in all other zones. <br />An adjustment to provide buildings that exceed the maximum 150-feet building dimension on <br />each street facing elevation. Per EC 9.5500(6)(c), adjustments may be made to the Building Mass <br />and Façade standards if consistent with the criteria at EC 9.8030(8)(a) Multiple-Unit Standards <br />Adjustment – Maximum Building Dimension. <br /> <br />The proposed adjustment balances the specific standard with other variables informing the building <br />design. The Adjustments facilitate adjustments to the development standards in an efficient and effective <br />manner. As demonstrated in Section IV below, the proposed Adjustment Review application meets the <br />applicable approval criteria in effect at the time of filing and should be approved as proposed. <br />
