Deron has rer ed but Anthony Drummond says <br />he’ll look through the project files to see what he can find. I’ll share anything I get with you. While I wait for that I’m <br />tackling other parts of the project, which has led to a new queson for you. <br /> <br />The A&T Descripon Card for TL 7000 says it was cre ated by lease. Book 186, Pages 60-61 dedicates W 6th Ave right-of- <br />way to ODOT and includes TL 7000 so my conclusion is the lease gave a private property owner the opportunity to ulize <br />a poron of the right-of-way. Recepon Number 2018-0 55413 transferred jurisdicon to the city for that secon of <br />right-of-way. Did the city receive ODOT’s documents as part of that jurisdicon transfer? I’d like to learn more about the <br />lease. Am I right that the adjoining private property owner was the lessee and ODOT the lessor? Has the lease <br />terminated (lack of payment, only while ODOT had the right-of-way, change in adjoining ownership, etc.) or is it sll in <br />effect? <br /> <br />Also, I noced in the jurisdicon transfer a clause that says tle reverts to ODOT if the city no long er uses the land for <br />right-of-way. There’s quite a lot of distance between back of sidewalk and right-of-way line. Do you read Book 186, <br />Pages 60-61 as conveying tle vs easement? How does that clause in the jurisdicon transfer affect a vacaon <br />applicaon? If the city vacates their right-of-way rights, will the client then need to purchase tle from ODOT? Will <br />ODOT be involved (commenng or decision making) in the vacaon process? <br /> <br />I’m guessing you’ll need some me to invesgate bef ore responding.
