This proposal does not include new development and there are no other features explicitly <br />included wherein development standards are applicable. Any future development will be <br />subject to review for consistency with applicable codes at the time of building permit <br />application. This standard does not apply. <br />(4) The following easements are shown on the tentative plan: <br />(a) Easements necessary for locating, accessing, replacing, and servicing all utilities; <br />The proposed Middle Housing Land Division complies with this criterion, as the applicant has <br />proposed adequate easements for locating, accessing, replacing, and servicing all utilities, <br />including water, wastewater, and electric service. As depicted on the site plan, the applicant <br />has proposed 5 foot wide public utility and access easement which is located along the <br />southern property line of Middle Housing Lot (Parcel) 1 and western property line of Middle <br />Housing Lots (Parcels) 2 and 3. Further, a 5 foot wide public utility easement is proposed along <br />the southern property line of Middle Housing Lot (Parcel) 2 and northern property line of <br />Middle Housing Lot (Parcel) 3. <br />The following assessment evaluates the needs for easements for utilities. <br />Water: As proposed, private water service to each lot is proposed to be located within a 5 foot <br />public utility easement on Middle Housing Lot (Parcel) 1 to allow Middle Housing Lots (Parcels) <br />2 and 3 access to water service. Currently, Middle Housing Lot (Parcel) is served by the existing <br />water line and meter in Jackson Street to the existing dwelling. <br />4. Prior to final plat approval, the applicant will provide evidence that a separate <br />water service line is provided to Middle Housing Lots (Parcels) 2 and 3 outside <br />the bounds of Middle Housing Lot (Parcel) 1; or a private utility easement may <br />be provided from Middle Housing Lot (Parcel) 1 for the benefit of Middle <br />Housing Lots (Parcels) 2 and 3. Alternatively, the applicant may provide a deed <br />restriction that holds the proposed parcels under common ownership as one <br />development site until such time as either the separate water service lines have <br />been provided to Middle Housing Lots (Parcels) 2 and 3 that are outside the <br />bounds of Middle Housing Lot (Parcel) 1, or that a private utility easement has <br />been provided and utilities located in the easement. <br />Wastewater: As proposed, Public Wastewater is available along the east property lines of <br />Middle Housing Lots (Parcels) 2 and 3 in Adams Alley. Further, the private wastewater <br />configuration is shown with a proposed public utility easement along the common boundary of <br />Middle Housing Lots (Parcels) 2 and 3 to allow Middle Housing Lot (Parcel) 1 access to <br />wastewater service. No development of the dwelling units is shown as part of this application. <br />As an informational item, the proposed easement appears to be labeled public for the private <br />wastewater utility.
