(3) The proposed middle housing land division complies with all of the following: <br />(a) EC 9.2777, Middle Housing Lot standards; <br />The proposed Middle Housing Lots meet the Middle Housing Lot standards, in that each <br />proposed Middle Housing Lot will contain one dwelling unit capable of complying with the <br />definition of a middle housing unit. As is stated on the site plan for this application, the <br />proposed Middle Housing Lots may not be further divided. Additionally, there are no frontage, <br />width, or lot area standards for Middle Housing Lots. Based on the above findings, these <br />standards are met. <br />(b) EC 9.6505, Improvements, Specifications for any street frontage improvements <br />required for middle housing lots that abut a street; <br />1. Water Supply. <br />Referral comments from Eugene Water & Electric Board (EWEB) confirm the site is currently <br />served by the EWEB water system and that additional service is available. The existing dwelling <br />on Middle Housing Lot (Parcel) 1 is served by the existing water line in Jackson Street. Based on <br />the tentative site plan, the applicant proposes to construct private water service lines from the <br />water line in Jackson Street to serve Middle Housing Lots (Parcels) 2 and 3. <br />Further review of the installation and placement of meters will be reviewed by Eugene Water <br />and Electric Board. Referral comments from EWEB are included in Attachment A. <br />This standard is met. <br />2. Sewage. <br />EC 9.6505(2) requires all developments to be served by the wastewater sewage system of the <br />City and in compliance with the provisions of Chapter 6 of the Eugene Code. <br />The existing dwelling on Middle Housing Lot (Parcel) 1 is currently connected to an existing 12 <br />inch wastewater service line that runs north and south along the east property line of Middle <br />Housing Lots (Parcels) 2 and 3 in Adams Alley. The applicant has proposed that the existing <br />wastewater line for Middle Housing Lot (Parcel) 1 be rerouted into the proposed utility <br />easement across the common boundary of Middle Housing Lots (Parcels) 2 and 3. Additionally, <br />based on the tentative site plan, Middle Housing Lots (Parcels) 2 and 3 will also be served by <br />the existing 12 inch wastewater service line in Adams Alley. <br />Although staff find this to be a feasible proposal, further review will be necessary during the <br />building permit process. Necessary easements for wastewater connection are addressed under <br />EC 9.8194(4)(a) below. <br />Based on these findings, the proposed Middle Housing Land Division complies with applicable <br />wastewater requirements. <br />December 2025 Findings & Decision: Action Jackson (MHT 25-35) Page 5 of 14 <br />
