Public Notice and Referrals <br />In accordance with House Bill 2138, if requested by the applicant, an application for Middle <br />Housing Land Division may be processed in accordance with the Expedited Land Division <br />procedures in state law. In this case, the applicant has requested review of this Middle Housing <br />Land Division application subject to the amended Expedited Land Division procedures of ORS <br />197.365, as amended by House Bill 2138. Pursuant to House Bill 2138, this decision may only be <br />appealed by the applicant. Appeals to Expedited Land Division determinations are subject to <br />the amended provisions of ORS 197.830 to 197.855, as amended by House Bill 2138. <br />The Planning Division provided information concerning the application to other appropriate City <br />departments, public agencies, and service providers. All referral comments received by the <br />Planning Division on this application are included in the application file for reference and <br />addressed in the context of the applicable approval criteria and standards in the following <br />evaluation. Additional Informational Items are also attached at the end of this Decision. <br />Fvaluatinn <br />Per the applicant's request, this Middle Housing Land Division application is subject to the <br />Expedited Land Division procedures listed in ORS 197.365, as amended by Enrolled House Bill <br />2138. The following evaluation addresses details of the proposal in the context of compliance <br />with the applicable approval criteria and related standards of the Eugene Code. <br />In accordance with EC 9.8194, the Planning Director shall approve, conditionally approve, or <br />deny the tentative Middle Housing Land Division application based on compliance with the <br />listed criteria. Those criteria are provided below (in bold) with respective findings that address <br />compliance. <br />EC 9.8194 Middle Housing Land Division, Tentative Plan Approval Criteria. <br />The planning director shall approve, conditionally approve, or deny the middle housing <br />land division tentative plan application based on compliance with the following criteria: <br />(1) If the property to be divided is not yet developed with middle housing: <br />(a) The application proposes development of middle housing on the lot or parcel to be <br />divided; and <br />(b) The lot or parcel to be divided is developable with middle housing consistent with <br />the following: <br />1. EC 9.2750; <br />2. EC 9.2751; <br />3. EC 9.2760; <br />4. EC 9.2761; <br />5. EC 9.2775; and <br />6.
