Did the applicant opt-in to review of this application in accordance with <br />new state law procedures (HB 2138)? <br />Comments: 1. EC 9.5550(2): There is some contradiction in the narrative/application materials about the existing dwelling. On <br />page 9, under EC 9.5550(2)(a), the materials state: “The site has 1 existing dwelling and is a duplex.” This implies <br />that there are two (2) units already developed on the subject property, which would make this proposed division <br />a triplex or quadplex middle housing land division (depending on whether the applicant proposes 1 or 2 <br />additional units). In other parts of the narrative, however, the application materials state that this is a duplex <br />division, and “each of the proposed lots will contain one middle housing unit, and “Middle Housing Lot Parcel 1 <br />has one unit…” One middle housing unit per lot would mean that the existing structure is a single-unit dwelling, <br />not a two-unit dwelling. RLID also states that the existing structure is classified as “Single Family Housing.” Please <br />clarify the number of units that are in existence on the subject property. If there are already two (2) units, then <br />the application must be revised to reflect this. If there is only one (1) unit, please clarify this. <br />1. EC 9.8194(5): This criterion requires “Separate utilities are provided for each dwelling unit,” the application <br />narrative states: “See Tentative Middle Housing Land Division plan for location and the note on the plan that <br />ensures compliance.” The tentative plan does not show the location of proposed separate utilities for each <br />dwelling unit, nor is there a note on the plan that ensures compliance. <br /> <br />For Middle Housing Yet to be Developed <br />Submitted Missing Incomplete N/A <br />☒ ☐ ☐ ☐ 1.
