Applicants for Middle Housing Land Division can now opt- <br />in to have their application reviewed in accordance with recently updated state law procedures for Expedited Land Divisions. <br />Here is a summary of the changes: <br /> <br /> Public Notice: New state law procedures do not require public notice to be sent to neighboring properties, while Eugene <br />Code procedures for Middle Housing Land Divisions require Public Notice of the application and Public Notice of the <br />decision to be sent to neighboring properties within 100 feet of the site. <br /> Appeals: Under the new state law, only the applicant can submit an appeal of the Tentative Middle Housing Land Division <br />decision. Eugene Code procedures allow for appeals to be submitted by any Interested Party who provided public <br />testimony during the public comment period. <br /> Local Appeals: Middle Housing Land Division decisions reviewed in accordance with new state law procedures can only <br />be appealed to the Land Use Board of Appeals (i.e., no local appeal process).
