<br /> Page 2 of 2 <br /> <br />9.8410 Property Line Adjustment Application Requirements <br />In addition to the provisions in EC 9.7010 Application Filing, the following specific requirements shall <br />apply to property line adjustment applications. <br />(1) Except for parallel property line adjustments when the adjusted property line is a distance of <br />even width along the common boundary, all applications shall be prepared by an Oregon <br />licensed Land Surveyor. <br /> <br />Brent W Corning, 89960PLS, exp 12/31/2025 <br /> <br />9.8415 Property Line Adjustment Approval Criteria <br />The planning director shall approve, approve with conditions, or deny the property line adjustment <br />application. Approval or approval with conditions shall be based on compliance with the followi ng <br />criteria: <br />(1) Planning: Any buildings to be retained on the properties comply with the minimum front and <br />interior yard setbacks and defined in this land use code. <br />(2) The final configuration of property lines shall not reduce an existing lot below the minimum lot <br />standards established in this land use code or otherwise violate standards of this land use code, <br />building codes, and fire codes, and Chapter 7. <br /> <br />• Incomplete: The 5-foot wide EWEB easement currently located on the northern portion of Property 2 <br />appears that it will cross both properties once the property line has been adjusted. Please confirm with <br />EWEB that the proposed configuration will not negatively impact the easement. <br /> <br />(3) The final configuration of property lines shall not violate any previous requirements or <br />conditions of approval imposed with a prior applicable land use decision. <br /> <br />No prior land use application requirements or conditions related to Public Works issues were found <br />that would be inconsistent with the proposed property line adjustment. <br />(4) Public assessments, liens, and fees with respect to the property line adjustment have been paid, <br />or: <br />(a) A segregation of assessments and liens has been applied for and granted by the city; or <br />(b) An adequate guarantee in a form acceptable to the city manager has been provided assuring <br />the liens, assessments and fees will be paid prior to recording the property line adjustment. <br /> <br />Approval of a property line adjustment does not relieve the applicant from complying with all <br />applicable codes or statutory requirements. <br />There are presently no outstanding liens or assessments on subject properties. Therefore, the criterion <br />is met.
