Final Subdivision Plat Approval for <br />WILLOW RIDGE ST 23-4 <br /> Metro Planning, Inc. September 9, 2025 P a g e | 2 <br /> <br />Background <br />This tentative partition application proposed to create 95 Lots out of 1 legal lot and is to be reviewed under the <br />General Criteria. The subject property is located on Pitchford Avenue west of Westec Drive. There are no existing <br />dwellings on the subject property. <br /> <br />This written statement addresses the approval criteria for a final partition at EC 9.8565. The approval criteria for a <br />final partition are in italics and the responses are included in plain text. <br />Subdivision, Final Plat Approval <br />EC 9.8565 Subdivision, Final Plat Approval Criteria <br />(1) Streets, roads, and alleys for public use are dedicated without any reservation or restriction other <br />than reversionary rights upon vacation. <br /> <br />There are required public dedications for streets, bicycle paths, accessways, or alleys and is dedicated as part of <br />the final subdivision plat. <br /> <br />(2) Public improvements as required by this land use code or as a condition of tentative plan approval <br />have been completed, or: <br />a) A performance bond or suitable substitute as agreed upon by the city has been filed with <br />the city finance officer in an amount sufficient to assure the completion of all required <br />public improvements; or <br />b) A petition for public improvements and for the assessment of the real property for the <br />improvements has been signed by the property owner seeking the subdivision, and the <br />petition has been accepted by the city engineer. <br /> <br />Public improvements are being done, a petition for public improvements and for the assessment of the real <br />property for the improvements will be provided for the PEPI work by the property owner seeking the subdivision, <br />and the petition will be accepted by the City Engineer prior to final plat approval. <br /> <br />(3) Conservation areas, including natural resource buffers and tree preservation areas, have been <br />designated as required by this land use code or as a condition of tentative approval; and a <br />performance bond, or suitable substitute as agreed upon by the city has been filed with the city <br />finance officer in an amount sufficient to assure the implementation of any natural resource <br />protection or restoration requirements of the tentative subdivision approval. <br /> <br />The tree preservation area is noted on the face of the plat, within Tract A. Tract A will be deeded to the HOA at <br />the end of construction and just left as is. <br /> <br />(4) Public assessments, liens, and fees with respect to the subdivision have been paid, or a guarantee <br />acceptable to the city manager has been provided assuring the liens, assessments, and fees will be <br />paid prior to recordation. <br /> <br />No public assessments, liens, or fees are known to exist with respect to the subject property. However, the <br />property owner will pay any assessments, liens, and/or fees if any are discovered. <br /> <br />(5) All conditions of tentative approval have been met and the final plat substantially conforms with <br />the provisions of the approved tentative plan.
