Compliance with Eugene Code (“EC”) 9.8405, Applicability of Property Line Adjustment Applications <br />EC 9.8405 <br />(1) A property line adjustment application is applicable to changes to the property lines of adjoining <br />properties when all of the following exist: <br />(a) A property line proposed for adjustment will not result in an increase in the number of <br />parcels or lots. <br />Response: <br />The proposed PLA will not result in an increase in the number of parcels or lots. Therefore, this <br />application complies with EC 9.405(1)(a). <br />EC 9.8405(1)(b): A property line proposed for adjustment will not create more than 2 property <br />line adjustments to any of the boundaries of an individual lot or parcel within a calendar year. <br />This subsection does not apply to proposed property line adjustments undertaken by or on behalf <br />of a governmental entity that affect the ability to preserve, manage, or expand park, open space, <br />or natural resource areas. <br /> <br />Response: <br />The proposed PLA is the only PLA that has been proposed for either subject property in the calendar <br />year. Therefore, this application complies with EC 9.405(1)(b). <br />EC 9.8405(1)(c): The adjustment will result in less than a 200% change in the size of the lot or parcel. <br />This subsection does not apply to proposed property line adjustments undertaken by or on behalf of a <br />governmental entity that affect the ability to preserve, manage, or expand park, open space, or natural <br />resource areas. <br />Response: <br />Subject Property 1 is presently 0.14A, and after the proposed PLA, Subject Property 1 will be 0.19A. <br />Thus, the proposed PLA will adjust the size of Subject Property 1 by 35.7%. <br />Subject Property 2 is presently 0.22A, and after the proposed PLA, Subject Property 2 will be 0.17A. <br />Thus, the proposed PLA will adjust the size of Subject Property 2 by 22.7%.
