<br /> <br /> <br /> <br />5 <br />As the size of both subject properties will be adjusted by less than 200%, this application complies with <br />EC 9.8405(1)(c). <br /> EC 9.8405(2) A property line adjustment application may not be utilized to effect the <br />reconfiguration of lots or parcels which must be approved through the partition or subdivision <br />procedure. <br />Response: <br />In the EC, “reconfiguration” is defined in EC 9.0500, which provides: <br />Reconfiguration of Lots or Parcels. Changes to legal lot lines that result in any of the following: <br />(A) Creation of an additional lot or parcel; <br />(B) More than 2 changes to any of the boundaries of an individual lot or parcel within 1 <br />calendar year; <br />(C) A change in the size of a lot or parcel by more than 200 percent; or <br />(D) Creation of substandard public facilities or services, including, but not limited to, <br />streets (access and widths), access easements, and public utility easements. <br />The proposed PLA does not create an additional lot or parcel, does not make more than 2 changes to any <br />boundary of either subject property within 1 calendar year, does not change the size of either property by more <br />than 200%, and does not create a substandard public facility or service. <br />Therefore, this application does not “effect the reconfiguration” of a lot or parcel, and thus, complies <br />with EC 9.8405(2). <br />EC 9.8405(3) A property line adjustment application may not be utilized to create flag lots. <br />Response: <br />The proposed PLA will not create a flag lot. Therefore, this application complies with EC 9.8405(3). <br />3. Compliance with EC 9.0500, Definitions: Legal Lot <br />Legal Lot: A lot of record that has boundary lines that were established: <br />(A) Through a partition or subdivision procedure, <br />(B) By a deed that was signed before April 2, 1962, or <br />(C) Through approval of an application to validate a unit of land consistent with <br />ORS 92.176.
