<br />July 2025 Findings & Decision of the Planning Director Page 8 of 10 <br />Headwaters Trail Electric Upgrade (SDR 25-1) <br />The applicant acknowledged this limitation within their application and agreed to this <br />requirement. To ensure compliance with this standard, the following condition is warranted: <br />2) The applicant shall add the following note to the final site plans, “The use of <br />heavy machinery within a conservation area or water resource shall be limited to <br />the period of June 15 and September, unless otherwise approved by the <br />planning director.” <br />Based on the above findings and condition of approval, this standard is met, and the requested <br />time extension is approved. <br />2. Use of heavy machinery shall be the minimum necessary for the use or activity <br />and shall be restricted to those areas where its use is necessary. <br />The applicant states that equipment will be limited to th ose areas necessary to do the work <br />required for replacement and new underground installation. The applicant’s site plans reflect <br />this fact, showing a limited area of impact and overall scale of work occurring within the <br />conservation areas and resource itself. Based on the available information, this standard is met. <br />(b) Petroleum products, chemicals, or other deleterious materials used in the <br />construction process shall not be allowed to enter a stream or wetland that is within a <br />/WR conservation area. <br />The applicant indicates that Best Management Practices will be used during the project. The <br />applicant’s written narrative also states, “The use of petroleum products, chemicals, or other <br />deleterious materials used in the construction process shall not be allowed to enter Amazon <br />Creek. Spill kits will be stocked in work vehicles, and spill response procedures will be followed <br />in the instance of a spill.” It is noted that these measures are consistent with the standards, <br />however, to ensure compliance with this standard, the following condition is warranted: <br />3) The applicant shall add a note to the final site plans: “Petroleum products, <br />chemicals, or other deleterious materials used in the construction process shall <br />not be allowed to enter a stream or wetland that is within a /WR conservation <br />area.” <br />Based on the above findings and condition, this standard is met. <br />(5) Filling, Grading and Excavating. Filling, grading and excavating within the /WR <br />conservation area and within areas removed from the /WR conservation area shall comply <br />with the following standards: <br />(a) Filling, grading or excavating of more than 500 square feet must comply with Erosion <br />Prevention regulations for sensitive areas in EC 6.645. <br />The applicant included erosion prevention methods within their application to help <br />demonstrate their proposed compliance with this requirement given that the project will <br />include greater than 500 square feet of excavation.
