The Proposed Property Line Adjustments are Not Prohibited by EC 9.8405 <br />Although not criteria for approval, section 9.8405 includes limitations on the use of property line <br />adjustments. The proposed property line adjustments are not prohibited by these limitations. <br />(I) A property line adjustment application is applicable to changes to the property lines of adjoining <br />properties when all of the following exist: <br />(a) A property line proposed for adjustment will not result in an increase in the number of parcels or lots. <br />The proposed property line adjustment will not result in an increase in the number of parcels or lots. <br />The proposed property line adjustments will adjust the boundaries of lots 5601, 4701, 4700 and 4601 as depicted <br />in the attached site plans and will not result in the creation of an additional lot or parcel. The property line <br />adjustments conform to this limitation. <br />(6) A property line proposed for adjustment will not create more than 2 property line adjustments to any of <br />the boundaries of an individual lot or parcel within a calendar year. This subsection does not apply to <br />proposed property line adjustments undertaken by or on behalf of a governmental entity that affect the ability <br />to preserve, manage, or expand park, open space, or natural resource areas. <br />As depicted in the applicant’s site plans, the proposed adjustment will not create more than 2 property <br />line adjustments to any of the boundaries of an individual lot or parcel within a calendar year. The property <br />line adjustments conform to this limitation. <br />(c) The adjustment will result in less than a 200% change in the size of the lot or parcel. This subsection <br />does not apply to proposed property line adjustments undertaken by or on behalf of a governmental entity <br />that affect the ability to preserve, manage, or expand park, open space, or natural resource areas. <br />The adjustment will result in less than a 200% change in size of each of the lots or parcels. The first <br />property line adjustment will reduce Lot 5601 from approximately 3.85 acres to 1.97 acres, a change of <br />approximately 49 percent, and will increase Lot 4701 from approximately .99 of an acre to 2.87 acres, a change <br />of approximately 190 percent. The second adjustment will reduce Lot 5601 from approximately 1.97 acres <br />1.32 acres, a change of approximately 33 percent, and Lot 4700 will be increased from approximately .33 of an <br />acre to .98 of an acre, an increase of approximately 197 percent. The third adjustment will increase Lot 4601 <br />from approximately 1.02 acres to 1.06 acres, a change of approximately 3.9 percent, and will decrease Lot 4701 <br />(as amended) from approximately 2.87 acres to 2.83 acres, a change of approximately 1.4 percent. The property <br />line adjustments conform to this limitation. <br />(2) A property line adjustment application may not be utilized to effect the reconfiguration of lots or parcels <br />which must be approved through the partition or subdivision procedure. <br />The proposed property line adjustments do not propose to reconfigure lots or parcels in an existing <br />subdivision or partition in a fashion that would require a replat and does not propose the creation of an additional <br />unit of land or otherwise reconfigure the parcels at issue in a fashion that would require approval through a <br />subdivision or partition procedure. The property line adjustments conform to this limitation.
