viii. Condition 8: The proposed Variable Width Access and Utility Easement, <br />which is subject to City review and approval prior to recording with the <br />final plat, shall be cross-referenced on the plat and be accompanied by a <br />maintenance agreement for the shared driveway, which addresses the <br />rights and responsibilities of each parcel relative to the shared driveway. <br />ix. Condition 9: Include a note on the final plans that states, "Lots 6 & 7 shall <br />remain in common ownership until the existing duplex is removed." <br />x. Condition 10: In order to protect the conservation areas during <br />construction and development, fencing shall be required around all <br />conservation areas, with verification of the fencing prior to signing of the <br />final subdivision plat. The location of the fencing shall be subject to <br />verification during an on-site review by City Land Use Management staff. <br />The on-site verification must be requested and performed prior to <br />commencing any job site activities including tree removal, grading or <br />excavation work. On each lot, the conservation area fencing shall be <br />maintained on each lot until a certificate of temporary occupancy has <br />been issued. <br />xi. Condition 11: The applicant's final site plans shall be revised to show the <br />Critical Root Zone (CRZ) for each tree to be preserved, and to show and <br />account for the location of all public and private utility easements, or <br />grading/excavation that may impact the CRZ's of trees to be preserved. <br />xii. Condition 12: Include a note on the final plans that states, "All building <br />permits for construction on the lots (as well as PEPI permits and site <br />development permits) shall include a site plan in compliance with the <br />approved tree preservation plan. The building permit submittal shall <br />include sufficient detail to verify that no more than 30 percent of the <br />Critical Root Zones (CRZ) of trees to be preserved will be impacted by <br />construction activities on the lot, or a report from a certified arborist <br />verifying that the proposed construction activities can otherwise be <br />conducted in a manner that does not threaten the survival of the trees to <br />be preserved. Each building permit shall include tree protection fencing <br />to be erected at the perimeter of the CRTs for all trees to be preserved <br />or an alternative location as approved and documented by the certified <br />arborist and City)." <br />xiii. Condition 13: Include a note on the final plans that states, "No <br />excavation, grading, material storage, staging, vehicle parking or other <br />construction related activity shall occur in tree protection areas without <br />prior approval by a certified arborist and documentation of that approval <br />provided to the City. Construction and grading may occur on any lot <br />within the specified building area in a manner that does not adversely <br />impact trees identified for preservation." <br />xiv. Condition 14: Include a note on the final plan that states, "The removal of <br />trees indicated 'to be removed' is not required; said removal may occur <br />at the applicant or future owners' discretion." <br />Page 3 of 5
