exhibits and will conform to applicable provisions and requirements of the City <br />Code. <br />b. All Development Activities will be conducted under the supervision of a licensed <br />general contractor. <br />c. Development of the Property and any Development Activities will comply with <br />the approved final site plans included as Exhibit "B" to this Agreement. The <br />Planning Director's decision dated December 24, 2018 approving Developer's <br />tentative subdivision included 15 conditions of approval, of which conditions 1 <br />through 9 and 11 through 15 have been met with a recorded easement or with <br />the revised and approved final site plans attached to this agreement as Exhibit <br />B". Condition 10 is the only outstanding condition to be met. The conditions of <br />approval are as follows: <br />i. Condition 1: On the final plat, the applicant will dedicate a 10 foot wide <br />public bicycle-pedestrian access way easement that will connect from the <br />extension of Katy Lane to the northern boundary of Tax lot 17-04-02-21- <br />00500 (Awbrey Park). <br />ii. Condition 2: Prior to final plat the applicant will construct a 10 foot wide <br />concrete path within the 10-foot wide public bicycle-pedestrian access <br />way easement. <br />iii. Condition 3: Prior to final plat approval, a PEPI permit shall be issued for <br />the construction of public improvements. In lieu of a PEPI permit, a bond <br />or other financial instrument guaranteeing the construction of public <br />improvements shall be submitted by the applicant and accepted by the <br />City Engineer. <br />iv. Condition 4: The applicant shall submit a street tree agreement <br />application with a street tree plan to the City Urban Forester for review <br />prior to filing the final subdivision application. The applicant will be <br />required to submit a financial guarantee [e]nsuring street trees will be <br />planted and maintained in accordance with applicable EC 7.280 <br />requirements. The applicant shall obtain an approved street tree <br />agreement prior to final plat approval. <br />v. Condition 5: The applicant shall provide documentation that EWEB has <br />received a financial guarantee, ensuring water will be provided to each <br />lot in the plat. <br />vi. Condition 6: Prior to final plat approval, the applicant shall submit for City <br />review and approval two paper copies of the final plat, stamped by a <br />certified engineer, that include the following: A delineation of the SFHA <br />boundaries and the community number, map/panel number, and <br />effective date of the appropriate Flood Insurance Rate Map.; A note <br />indicating the BFE for each lot. If one BFE is used for the entire <br />development, it must be the most conservative; A narrative, dated and <br />stamped by the engineer or licensed surveyor explaining the <br />methodology used to determine the BFE. <br />vii. Condition 7: The final plat shall include a note stating which Lots are <br />within the SFHA and the BFE for those Lots. <br />Page 2 of 5
