Notwithstandingany otherprovision oftheEugene Code, 1971, agroup <br />ofupto40tents,orapprovedhut-structures,beingusedforovernight sleepingmaybe <br />temporarily erectedonproperty authorizedbymotion oftheCityCouncilforthatuse. <br />Dependingonthesizeoftheproperty, theCityCouncilmayauthorizetheco-locationof <br />multiplegroups. InadditiontoanyconditionsimposedbytheCityCouncilatthetimeof <br />siteapprovaltoaddresssite-specific issues, allSafeTentsitesauthorizedandestablished <br />pursuanttothisOrdinanceshallhaveadequategarbagecollection, toilets, handwashing <br />stations, andpotablewater, withagoalofprovidingrenewablepoweratallsanctioned <br />sites. <br />Section2. WhenaSafeParkingsiteisauthorizedandestablished pursuanttothis <br />Ordinance, those vehicles unlawfullyparkedonCityright-of-wayinWestEugeneshallbe <br />prioritizedforoccupying spacesattheSafeParkingsite. WhenaSafeTentsiteisauthorized <br />andestablishedpursuanttothisOrdinance, thosetentcampersat13thandChambersandin <br />Washington-JeffersonParkshallbeprioritized foroccupyingspacesattheSafeTentsite. <br />Section3. TheCityManagermayadoptrulespursuanttoEC2.019toregulatetheSafe <br />ParkingsitesandSafeTentsitesestablished pursuanttothisOrdinance. <br />Section4. ThisOrdinanceshallsunsetandberepealedonMay1, 2023, unless <br />extendedormadepermanent byfutureCouncilaction. <br />Section5. Duetotheimmediate needtoaddressthe significantincreaseinvehicular <br />livingandunsanctionederectionoftentcampsoccurringthroughoutthecommunityby <br />establishing lawfulsitestoparkvehiclesorerecttents, anemergencyisdeclaredtoexistthat <br />cannotbeaddressed bytheordinanceadoptionproceduresinSection28(1) oftheEugene <br />Charterof2002. PriortotheadoptionofthisOrdinance, theCityCouncilunanimously agreedto <br />proceed withconsiderationofthisOrdinancewithanabbreviatednoticeofthepublichearingdate. <br />Section6.
