ORDINANCE NO. 20650 <br />ANORDINANCEALLOWINGFORTHETEMPORARYESTABLISHMENTOF <br />SAFEPARKING” AND “SAFETENT” SITESTHATARELARGERTHAN <br />ALLOWEDUNDERSECTION 4.816OFTHEEUGENECODE, 1971; <br />DECLARING ANEMERGENCY; PROVIDINGFOR ANIMMEDIATE EFFECTIVE <br />DATE; AND PROVIDINGASUNSET DATE. <br />TheCity Council oftheCityof Eugenefindsasfollows: <br />A. Section4.816ofthe EugeneCode, 1971 (EC) setsforthvarioustypesof overnight <br />sleeping arrangementsthatarepermitted throughouttheCitywhencertainconditions aremet. <br />Some ofthepermittedovernight sleeping arrangements arepermitted outrightandothersrequire <br />theCityCounciltoapprovethelocation. WhetheroutrightedpermittedorapprovedbytheCity <br />Council, thepermittedovernight sleepingauthorized byEC4.816is cappedatthenumberof <br />allowedvehicles (whichincludesRVs, tents, andConestogahuts) rangingfrom1to20. <br />B. TheCityisexperiencing anincreaseinthenumberofindividuals livingincampers, <br />trailers, cars, andtentsinlocationsthatarenotintendedforthatpurpose. Thisoftenresultsin <br />unsanitary andunsafeconditionsforunhousedresidentsandforthesurroundingcommunity, <br />particularlythenearbybusinessesandresidences. Additionaloptionsareneeded forthese <br />individualstolawfullyparktheirvehiclesorsetuptheirtents. <br />C. TheCity’scarcampingandreststopprograms, whichlimitthenumberofallowed <br />vehicles/hutstosixandtwenty, respectively, areprovensuccessesandareessentialoptionsfor <br />theunhoused. However, toeffectivelyaddressthelargenumberofvehiclesandtentsthatare <br />an immediate healthandsafetyconcern, thereis aneedfortemporary sites thatcan <br />accommodatemorevehicles andtents/hutsthancurrentlyallowedbyEC 4.816. Theneedfor <br />theselargersites where peoplecantemporarilysleep overnightinparked vehicles anderected <br />tents, isacute and immediate. <br />D. Temporarily allowingforthe establishment ofsites thatwillaccommodatealarger <br />number of vehicles ortentsthan currentlyallowedbyEC4.816, shouldbeimmediately <br />establishedandremainineffectuntil May1, 2023. <br />NOW, THEREFORE, <br />THECITYOFEUGENEDOESORDAIN AS FOLLOWS: <br />Section1. Thefollowingprovisionsareadopted to temporarily allow theestablishment <br />of SafeParkingsitesandSafeTent sites. <br />Safe Parking Sites. Notwithstandinganyotherprovision oftheEugeneCode, 1971, a <br />groupofup to60 vehicles beingusedforovernight sleeping maytemporarilyparkon <br />propertyauthorized bymotionoftheCityCouncil forthatuse. Forpurposes of this <br />provision, theterm “vehicle” includes acar, camper, ortrailer. Dependingonthesizeof <br />theproperty, theCityCouncil mayauthorize theco-locationofmultiplegroups.
