defining the area of the private street and will also identify permitted improvements, <br />construction expectations, rights of usage and maintenance responsibilities for the <br />facilities in the street. The JAM will be recorded concurrent with and cross-referenced on <br />the final plat. <br />6. Provisions for a public emergency access easement within the private street may be <br />included in the proposed JAM which creates the private street, or alternatively, may be <br />dedicated as a Public Emergency Access Easement on a standard City form. <br />7. Prior to final plat approval, the applicant shall dedicate a 14-foot Public Utility Easement or <br />Public Wastewater Easement that will encumber the proposed public wastewater system. <br />The required easement shall also be shown on revised final PUD plans. <br />8. The final PUD site plans shall include the following note: "No building, structure, tree or <br />other obstruction shall be placed or located on or in a Public Utility Easement, consistent <br />with EC 9.6500(3)". <br />9. The final PUD site plans shall include the following note: "Compliance with public <br />improvement requirements shall be demonstrated in accordance with EC 9.6505 as part of <br />the permitting process for development within the PUD including Privately Engineered <br />Public Improvement (PEPI) Permits, Site Development Permits and Building Permits." <br />10. The final PUD site plans shall include the following note: "A Privately Engineered Public <br />Improvement (PEPI) permit shall be issued for the construction of public improvements <br />prior to development." <br />11. Prior to final plat approval, the applicant shall provide documentation that EWEB has <br />received a financial guarantee, ensuring water will be provided to each lot in the plat. <br />12. Prior to final PUD approval, the applicant shall submit an updated site plan that depicts <br />wastewater service to Lot 38. Alternatively, the applicant may combine Lots 37 and 38 to <br />demonstrate compliance with the requirement for wastewater service. <br />13. The applicant shall submit an Irrevocable Petition for public improvements in Hawkins Lane <br />to include sidewalks. <br />14. The applicant shall submit an Irrevocable Petition for public improvements in Randy Lane <br />(existing portion between Hawkins Lane and Blacktail Drive) to include setback sidewalks <br />and street trees. <br />15. The proposed Joint Access Easements, which are subject to City review and approval prior <br />to recording with the final plat, shall be cross-referenced on the plat and be accompanied <br />by a maintenance agreement for each shared driveway, which addresses the rights and <br />responsibilities of each parcel relative to each shared driveway. <br />16.
