criteria. The Hearings Official addressed the concurrent Tentative Subdivision application <br />acknowledging that: <br />As reflected in the Staff Report, the staff relied almost exclusively on its analysis of the PUD <br />approval criteria in determining that the proposed subdivision also satisfied the tentative <br />subdivision approval criteria. To the extent the review of the proposed development <br />satisfies the PUD approval criteria, the corresponding tentative subdivision approval <br />criteria are also satisfied. <br />To the extent the Hearings Official relied on a denial of the Tentative PUD to also deny the <br />Tentative Subdivision, the Planning Commission finds that the modifications as described above to <br />the findings and conditions under the Tentative PUD criteria at EC 9.8325(3), EC 9.8325(4), EC <br />9.8325(5)(d) and EC 9.8325(5)(j), allow the approval of the Tentative PUD and the Tentative <br />Subdivision by incorporating those findings by reference under identical Tentative Subdivision <br />criteria. <br />Based on all the above, the Planning Commission modifies the Hearings Official's decision to <br />conclude that any modification to the Hearing Official's findings regarding the Tentative PUD <br />application should also modify any identical Hearings Official findings regarding the Tentative <br />Subdivision application. <br />V. CONCLUSION <br />The Eugene Planning Commission has reviewed the record and the assignments of error in the <br />appeal and has voted to reverse and/or modify portions of the Hearings Official's decision and <br />impose the conditions of approval discussed in this Final Order. Therefore, the Planning <br />Commission hereby approves Tentative PUD and Tentative Subdivision applications for Braewood <br />Hills 3rd Addition (PDT 24-1 and ST 24-3) subject to the following conditions of approval: <br />1. On the final PUD site plans and final plat, the applicant shall create an access restriction <br />strip along the westerly boundary line of Lot 15 abutting Hawkins Lane. <br />2. Prior to final plat approval, the applicant shall demonstrate approval from the regional <br />road naming group for alternate street names to replace "Stonehedge Way" and <br />"Stonehedge Court". <br />3. The private streets shall be labeled on the final plat and final PUD site plans as "[Approved <br />Street Name] - Private". <br />4. The structural design and construction inspection for the private streets will remain the <br />developer's responsibility. Certification by a licensed engineer that a structural design <br />meeting the applicable standards will be required at the time of the site development <br />permit for the private street. <br />5. Prior to final PUD and plat approval, the applicant shall submit Private Joint Use Access and <br />Utility Easement and Maintenance Agreement (JAM).
