East 32nd Avenue Lot Validation Page 3 of 3 <br />Lot Validation: Written Statement <br />February 14, 2025 <br /> <br /> <br /> <br />Schirmer Consulting, LLC  PO Box 10424, Eugene, OR 97440  (541) 234-5108 <br />Landscape Architecture + Land Use Planning <br />(b) Could have complied with the applicable criteria for the creation of a lawfully established unit of <br />land in effect when the unit of land was sold. <br /> <br />When the unit of land was sold, the land could have complied with the lot standards in effect at <br />the time (Ordinance 12769, dated August 14, 1962). <br /> <br />Original lot 9900 and 9902 had a total frontage of 113.70’. Resulting Lot 9900 exceeded the <br />requirement of 60’ in width and frontage with a width and frontage of 61.7 feet. <br /> <br />The minimum lot area is 6,000 sf per lot. Lot 9900 is 6,168 sf. exceeding the minimum <br />requirement of 6,000 sf. <br /> <br />Furthermore, at the time the deed was created the owners could have utilized either a Property <br />Line Adjustment process or a Replat of the property. Neither of these processes were used to <br />convey property and to create these lots. <br /> <br />ORS 92.177 Creation of parcel by less than all owners of lawfully established unit of land. <br />When a unit of land was sold before January 1, 2007, but was not a lawfully established unit of land, the <br />governing body of the city or county or its designee shall consider and may approve an application for the <br />creation of a parcel pursuant to ORS 92.176 (Validation of unit of land not lawfully established), <br />notwithstanding that less than all of the owners of the existing lawfully established unit of land have <br />applied for the approval. <br /> <br />The information demonstrates that the subject property meets the criteria to be validated as a single unit <br />of land since it was illegally created through a deed recorded after 1962, but prior to 2007.
