Metro Planning, Inc Middle Housing Tentative Partition for Cunningham Trust January 2025
Page | 2

EC 9.8194 – Middle Housing Land Division, Tentative Plan Approval Criteria.

The planning director shall approve, conditionally approve, or deny the middle housing land division tentative plan
application based on compliance with the following criteria:

(1) If the property to be divided is not yet developed with middle housing:

(a) The application proposes development of middle housing on the lot or parcel to be divided; and
(b) The lot or parcel or be divided is developable with middle housing consistent with the following:

1. EC 9.2750;
2. EC 9.2751;
3. EC 9.2760;
4. EC 9.2761;
5. EC 9.2775; and
6. EC 9.5550.

Response: The subject property is already developed with middle housing. There is an existing detached duplex on the subject
property. The proposed middle housing partition will effectively result in one dwelling unit on each new middle housing lot. No additional
development is proposed with this application. EC 9.8194(1) is not applicable to this proposal.

(2) If the property to be divided is developed with middle housing:

(a) The middle housing complies with EC 9.5550; or
(b) The certificate of occupancy for the middle housing was issued before June 30, 2022, and the middle housing
complied with applicable land use requirements at the time the certificate of occupancy was issued.

Response: In compliance with EC 9.8194(2)(a), the subject property to be divided was developed with middle housing prior to June 30,
2022. The dwelling fronting W 15th Avenue (Dwelling 1) was effectively built in 1956; inspected by the City of Eugene in 1993. The
dwelling on Chambers Alley (Dwelling 2) was effectively built in 1974; inspected by the City of Eugene in 1993.
See the attached RLID reports. Additionally, the existing detached duplex complies with EC 9.5550; applicable standards addressed
below.

EC 9.5550 – Middle Housing Development Standards.

(1) Purpose of Middle Housing Development Standards. The purpose of these development standards is to:

(a) Ensure that new middle housing development enhances the variety of housing options available to Eugene’s
residents;
(b) Ensure consistency with state requirements for middle housing;
(c) Promote development of middle housing that provides opportunities for both rental and ownership housing;
(d) Provide an adequate supply and range of housing types and prices that will meet the city’s future population
growth;
(e) Promote building and site design that contributes positively to a sense of neighborhood and to the overall
streetscape; and
(f) Provide a physical environment that contributes to and enhances the quality of life.

Response: This middle housing land division intends to fulfill the standards and objectives enumerated in (a)-(f), above. Partitioning the
subject property, effectively resulting in one individual dwelling unit located on its own lot, creates rental and more specifically ownership
opportunities that were not previously possible and enhances the variety of housing options available in the neighborhood without the
need for additional urban development. This proposal embodies the intentions of the middle housing development standards detailed
above.
