Metro Planning, Inc Middle Housing Tentative Partition for Cunningham Trust January 2025 <br />Page | 1 <br /> <br /> <br />Background <br /> <br />This Middle Housing Tentative Partition plan pertains to Assessor’s Map & Tax Lot 17-04-36-34-05300 (“subject property”), legally <br />established in 1909 as Lot 18, Block 25 of the Chambers Addition to Eugene, Oregon, as platted and recorded in Volume 3, Page 41, <br />Lane County Oregon Plat Records. The subject property is approximately 0.18 acres in size and is located on the southwest corner of <br />W 15th Ave and Chambers Alley between W 14th Ave (to the north) and W 15th Ave (to the south). The subject property is zone R-1 with <br />a Metro Plan Designation of Low Density Residential. There is an existing detached duplex located on the subject property with two site <br />addresses of 1740 W. 15th Ave and 1548 Chambers Alley. <br /> <br />This application proposes a Middle Housing Land Division that will partition the subject property into two middle housing lots with one <br />dwelling unit of the detached duplex on each lot. Proposed Parcel 1 will contain the dwelling with frontage on W. 15th Ave; Proposed <br />Parcel 2 will contain the dwelling with frontage on Chambers Alley. No new development is proposed with this Middle Housing <br />Tentative Partition plan; all existing development will remain. <br /> <br />For City staff review this written narrative delineates the proposal’s compliance with the Eugene Code (EC) criteria and requirements <br />for tentative approval of a Middle Housing Land Division application contained in EC 9.8193 – Middle Housing Land Division, Tentative <br />Plan Application Requirements and EC 9.8194 – Middle Housing Land Division, Tentative Plan Approval Criteria. Eugene Code <br />sections are indicated herein by bold and/or italic typeface; applicant responses follow in plain typeface. <br /> <br />EC 9.8193 – Middle Housing Land Division, Tentative Plan Application Requirements. <br /> <br />In addition to the provisions in EC 9.7010 Application Filing, the following specific requirements apply to middle housing land <br />division tentative plan applications: <br /> <br />(1) The tentative plan included in the middle housing land division application must be prepared by an Oregon licensed land <br />surveyor. <br /> <br />Response: The tentative plan included with this middle housing land division application was prepared by Oregon licensed land <br />surveyor, Jeremy Sherer, PLS of Sherer Land Surveying. <br /> <br />(2) The application must include a preliminary title report. <br /> <br />Response: A Status of Record Title (SORT) report #CT-0341091 is attached for the subject property. <br /> <br />(3) The application must identify all contiguous property under the same ownership as the property to be divided. <br /> <br />Response: There is no contiguous property owned by M Dianne Cunningham Trust. <br /> <br />(4) The application must be signed by the owner of the property to be divided. <br /> <br />Response: The application is signed by the trustee of the M Dianne Cunningham Trust (owner), Dianne Cunningham. <br /> <br />(5) The property to be divided must be a legal lot. <br /> <br />Response: The subject property is a legal lot of record as it was created in 1909 as Lot 18, Block 25 of the Chambers Addition to <br />Eugene, Oregon, as platted and recorded by deed in Volume 3, Page 41, Lane County Oregon Plat Records. See attached SORT <br />report #CT-0341091, Lane County Assessment & Taxation property description card, and Deed No. 2005-102397. <br /> <br /> <br />
