1 <br />AGENDA ITEM SUMMARY <br />January 14, 2025 <br />To: Eugene Planning Commission <br />From: Nicholas Gioello, Associate Planner, Eugene Planning Division <br />Subject: Public Hearing: Appeal of Hearings Official’s Decision on Tentative Planned Unit <br />Development and Tentative Subdivision Application for Braewood Hills 3rd Addition <br />(City Files: PDT 24-1 and ST 24-3) <br />ACTION REQUESTED <br />On January 14, 2025, the Planning Commission will hold a public hearing and possibly begin <br />deliberations on an appeal of the Eugene Hearings Official’s decision denying Tentative Planned Unit <br />Development and Tentative Subdivision applications for Braewood Hills 3rd Addition. The appellant, <br />who is the applicant for the proposal, has requested that the Planning Commission modify or <br />reverse the Hearings Official’s decision by resolving a series of asserted errors related to evidence, <br />findings, and conditions, and approve the Tentative Planned Unit Development and Tentative <br />Subdivision. <br />BRIEFING STATEMENT <br />The subject property is 15.47 acres in size and abuts the east side of Hawkins Lane and Randy Lane <br />in southwest Eugene. The area near the site is generally developed with single-unit homes and a <br />public street system. Videra Park abuts the property along the southern boundary. The site is zoned <br />R-1 Low-Density Residential with /PD Planned Unit Development Overlay and /WR Water Resources <br />Conservation Overlay. For reference, a vicinity map is included as Attachment A to this report. <br />The applicant, Piculell Properties, LLC, filed applications for a Tentative Planned Unit Development <br />(PUD) and Tentative Subdivision under the Housing/Clear and Objective approval criteria for those <br />application types to create a 39-lot residential subdivision with private streets and associated <br />infrastructure. For reference, a reduced-size copy of the proposed site plan is included as <br />Attachment B. <br />A copy of the Hearings Official’s decision is provided as Attachment C. Following the decision, the <br />applicant, represented by the Law Office of Bill Kloos, filed a timely appeal of the Hearings Official’s <br />decision. The applicant’s written appeal statement is provided as Attachment D. City staff mailed <br />written notice of the appeal hearing on January 3, 2025, consistent with land use code <br />requirements. <br />PLANNING COMMISSION ROLE <br />The Eugene Planning Commission serves the community in two main roles.
