28. The final PUD plans shall show compliance with the landscape standards of EC 9.6210(3) <br />High Screen Landscape Standard (L-3) along the northern property lines of Blocks G, H, J and <br />K. <br />Although the applicant notes that this condition is not applicable to the modification, staff disagrees. <br />The area subject to the modification falls partially in Block H, and is clearly subject to this condition, <br />which was imposed to screen the Crescent Village development from adjacent residential land and <br />uses to the north. To ensure compliance with this condition, the modified final PUD plans shall <br />demonstrate compliance with this condition. <br />The modified final PUD plans shall show compliance with the landscape standards of EC <br />9.6210(3) High Screen Landscape Standard (L-3) along the northern property line of Tract B. <br />29. Within the R-4 High Density Residential zoned portion of the site, the following conditional <br />uses shall be permitted: major transit facilities, medical clinics and health facilities, <br />churches, synagogues, temples, athletic facilities and day care facilities. The location of <br />these uses shall be limited to the mixed use buildings on Blocks B, C and D. <br />This condition is not applicable to the modification, as it does not include Blocks B, C or D. <br />30. Only those uses permitted outright in the C-1 Neighborhood Commercial zone shall be <br />permitted within the R-4 zoned portion of this PUD. The location of these uses shall be <br />limited to the mixed use buildings on Blocks, B, C, D, E and F. <br />This condition is not applicable to this modification, as it does not include the areas designated for <br />mixed use buildings on Blocks B, C, D, E and F. <br />31. The R-4 zoned portion of the site shall achieve a minimum net density of 25 units per acre at <br />full-build out. The "flex units" shall not be included in this density count. At each phase of <br />the final PUD, the applicant shall provide an accurate calculation of the density proposed for <br />the current phase, as well as the cumulative density that has been achieved in any earlier <br />approved and/or developed final phases, and a conceptual illustration of how the remaining <br />phases can achieve the required density. <br />The modification does not propose any changes to the number of dwellings or lots approved through <br />the final PUD. As such, the modification is consistent with this condition. <br />32. A minimum of 10% of the R-4 zoned portion of the site shall be provided as open space. <br />Required open space must comply with the standards of EC 9.5500(9)(a) and (b). The <br />portion of Block J proposed for right-of-way dedication cannot be included in the open <br />space calculations. At each phase of the final PUD, the applicant shall provide an accurate <br />calculation of the open space proposed for the current phase, as well as the cumulative <br />open space that has been achieved in any earlier approved and/or developed final phases, <br />and a conceptual illustration of how the remaining phases can achieve the required open <br />space. <br />The applicant provided a calculation of the open space proposed in this phase as well as the <br />Crescent Village Phase 1 (MDA 12-3) September 2012 Page 10
