are provided with respect to fire code requirements that will be further addressed in the subsequent permit <br />reviews. These comments are provided following the recommended conditions of approval. <br />Based on these findings, the proposal is consistent with this criterion. <br />EC 9.8320(7) Adequate public facilities and services are available to the site, or if public services <br />and facilities are not presently available, the applicant demonstrates that the services <br />and facilities will be available prior to need. Demonstration of future availability <br />requires evidence of at least one of the following: <br />a) Prior written commitment of public funds by the appropriate public agencies. <br />b) Prior acceptance by the appropriate public agency of a written commitment by the <br />applicant or other party to provide private services and facilities. <br />c) A written commitment by the applicant or other party to provide for offsetting all <br />added public costs or early commitment of public funds made necessary by <br />development, submitted on a form acceptable to the city manager. <br />Public Works staff concurs with the applicant's statement that required utility services are available for <br />extension to the development site and that other public facilities (i.e. emergency response, police, <br />public transit, schools, parks etc.) are available to the development site. The applicant is proposing to <br />construct all of the public improvements within the development site excluding the right-of-way from <br />Melville Avenue to the west. It is unclear if the applicant is proposing to construct the LTD transit <br />station, the signal at Crescent and Shadow View Drive, and the improvements on Crescent Avenue at <br />Coburg Road. If the applicant intends to provide the transit station in the manner proposed in the <br />applicant's tentative PUD plans, the applicant will need to provide sufficient assurance that the station <br />will be constructed. As part of the applicant's off-site traffic mitigation measures (identified in the <br />applicant's TIA and reiterated above), the applicant is responsible for installing the traffic signal at the <br />applicant's proposed location. <br />EC 9.8320(8) Residents of the PUD will have sufficient usable recreation area and open space that is <br />convenient and safely accessible. <br />As shown on the tentative site plans, the proposed PUD incorporates usable recreation area and open space <br />within the development site, and provides sidewalks and paths suitable for convenient access to nearby <br />recreation areas and open spaces. The proposed development includes several private park areas, as well <br />as open spaces adjacent to many of the residential buildings. In addition to the recreation area and open <br />space within the development, the subject property is adjacent to an 8-acre site owned by the City of <br />Eugene that is identified as a future park site. This property, located to the northeast of the proposed PUD <br />is east of a 32-acre vacant site owned by the Eugene 44 School District. Staff notes that there are no <br />approved plans for development of these site, however the City Parks and Open Space Division and the <br />School District have discussed a potential partnership to create a sports park on the combined properties. <br />Staff concludes that there is sufficient usable recreation area and open space for residents. <br />EC 9.8320(9) Stormwater runoff from the PUD will not create significant negative impacts on <br />natural drainage courses either on-site or downstream, including, but not limited to, <br />erosion, scouring, turbidity, or transport of sediment due to increased peak flows or <br />velocity. <br />According to the applicant, stormwater runoff will be discharged into the existing public stormwater <br />facilities along the east site boundary and Crescent Avenue.
