<br />information is already included in the Stormwater Management Manual and is not a code <br />requirement, therefore the amendment would remove this unneeded code language. <br /> <br />• EC 9.6792 Stormwater Quality <br />o EC 9.6792(2) Water Quality Applicability and Exemptions. As proposed, this subsection <br />would be amended to standardize the applicability and exception criteria to align with <br />the City’s NPDES permit. The NPDES permit requirements apply to all new development <br />and redevelopment creating or replacing 1,000 square feet or more of impervious <br />surface area discharging stormwater to the municipal separate storm sewer system. <br />Certain exemptions are provided including for replacement of impervious area that does <br />not expose more than 1,000 square feet of soil, maintenance or repair activities to <br />prevent decline, laps or cessation in use, and for situations when the water quality <br />requirement can be addressed by an existing appropriately sized water quality facility. <br /> <br />o EC 9.6792(3) Water Quality Standards. As proposed, this subsection would be amended <br />to emphasize and prioritize on-site retention of stormwater runoff through infiltration <br />and extended filtration. Infiltration and extended filtration facilities include vegetated <br />planters, rain gardens, swales and filter strips that improve water quality, reduce runoff <br />volumes, and can potentially increase capacity in the city’s stormwater system. These low <br />impact development and green infrastructure techniques seek to mimic a site’s natural <br />hydrology prior to development, thereby reducing the negative effects of stormwater <br />runoff on downstream rivers, lakes, streams and wetlands. <br /> <br />While the amendments will prioritize infiltration and extended filtration stormwater <br />quality facilities, applicants who do not have sufficient land area to install infiltration or <br />extended filtration facilities can participate in the City’s off-site stormwater quality <br />mitigation program through higher system development charges which will be used to <br />construct off-site stormwater quality by the City. An applicant may demonstrate <br />insufficient land area by submitting a report setting forth the required size of the smallest <br />infiltration or filtration facility needed for the development’s impervious surface area and <br />a site plan demonstrating that an approved infiltration or filtration facility cannot be <br />located on the development site without reducing the size of the proposed development <br />which is otherwise consistent with all other applicable lot and development standards. <br /> <br />• EC 9.6793 Stormwater Flow Control (Headwaters). As proposed, this Section would be amended <br />to update 9.6793(2) to standardize the applicability criteria to align with the City’s NPDES permit. <br />The NPDES permit requirements apply to all new development and redevelopment creating or <br />replacing 1,000 square feet or more of impervious surface area discharging stormwater to the <br />municipal separate storm sewer system. Certain exemptions are provided including for <br />replacement of impervious area that does not expose more than 1,000 square feet of soil, <br />maintenance or repair activities to prevent decline, laps or cessation in use, and for situations <br />when the flow control requirement can be addressed by an existing appropriately sized flow <br />control facility. <br />• EC 9.8030(24) Adjustment Review. Changes to the Adjustment Review provisions are to simply <br />correct and update the code references new stormwater standards.
