Accounting for the <br />vertical transitions at the top and bottom of the slope, the resulting street grade <br />would be 21%.” <br /> <br />The conclusion of the applicant and the staff that a connectivity standard is justified based on the <br />slope of the topography has a sound evidentiary basis. <br /> <br />3. City Utility and Stormwater Standards: The proposal meets city utility standards for <br />the proposed development and Middle Housing. Furthermore, full Middle Housing <br />development can, as a practical matter, be served consistent with city standards for public <br />improvements. <br /> <br />This application meets the current code standards that apply to this proposed use. Furthermore, <br />because the Middle Housing Statute allows up to four units on each lot, it is prudent for the <br />applicant to show that code standards relating to facilities can meet by the proposal. <br /> <br />(a) Water Supply: (discussed at Staff Report page 18). <br /> <br />The “water supply” standard is the first among the “public improvements – specifications” <br />standards stated at EC 9.6505. The introductory language and “water supply” requirement is <br />stated at 9.650t(1): <br /> <br />“All public improvements shall be designed and constructed in accordance <br />with adopted plans and policies, the procedures specified in Chapter 7 of this <br />code, and standards and specifications adopted pursuant to Chapter 7 of this <br />code. Additionally, all developments shall make and be served by the <br />following infrastructure improvements. <br /> <br />(a) Water Supply. All developments shall be served by the water <br />system of the Eugene Water & Electric Board.” <br /> <br />The Staff Report references the EWEB comments at Staff Report page 86 explaining that there is <br />an 8” main in Randy Lane to serve the subdivision. The current code standard requires proof of <br />service. EWEB has confirmed that service is available. That should suffice to support a finding <br />of compliance. <br /> <br />Nevertheless, because state law will allow Middle Housing, it is prudent to show that water <br />distribution can be done consistent with EWEB standards.
