_____________________________________________________________________________________ <br /> <br />Staff Report | Braewood Hills 3rd Addition (PDT 24-1 & ST 24-3) <br />March 2024 applications include essentially the same Tentative PUD and Subdivision proposal <br />for a 39-lot residential subdivision under the approval criteria in EC 9.8325 “Tentative Planned <br />Unit Development Approval Criteria - Housing/Clear and Objective” as the previously filed, void <br />applications. The applicant held a neighborhood/applicant meeting as required by code on May <br />7, 2024, in accordance with EC 9.7007. These most recent applications were deemed complete <br />on May 28, 2024, and are the subject of the staff report and evaluation provided below. <br /> <br />Application <br />Timeline* <br />Application Submitted March 29, 2024 <br />Application Deemed Complete May 28, 2024 <br />Public Notice (per EC 9.7315) June 10, 2024 <br />Public Hearing Scheduled July 10, 2024 <br /> <br />Public Notice <br />Public notice of these applications was provided in accordance with EC 9.7315 requirements. <br />This included both mailed notice and signage in the vicinity of the subject property about the <br />proposal and public hearing scheduled for July 10, 2024. <br /> <br />Testimony <br />Staff have received multiple email submissions in response to the public notice. All submissions <br />of written testimony are included as Attachment C to this Staff Report for ease of reference. <br /> <br />The May 13, 2024, Larry Smith submission expresses concern that previous approvals on the <br />site established a conservation area which prohibited construction in an area now proposed for <br />development. Mr. Smith appears to be referencing the prior approvals for Braewood Hills 3rd <br />Addition (PDT 01-11 and PDF 03-1), for a 181-lot residential PUD/Subdivision. As shown on the <br />site plan associated with PDT 01-11, the area of land being evaluated under this proposal was <br />approved at the time with a configuration of small lots, common open space and a conservation <br />area: <br /> <br />Page 5 of 87
