_____________________________________________________________________________________ <br /> <br />Staff Report | Braewood Hills 3rd Addition (PDT 24-1 & ST 24-3) <br />APPLICATION DETAILS, BACKGROUND & PROCEDURES <br />The applicant is requesting concurrent Tentative PUD and Subdivision approval to create 39 <br />lots, according to the City’s Type III land use application procedures at EC 9.7300-9.7340. The <br />applicant is requesting approval under the City’s relatively new “Housing/Clear and Objective” <br />approval criteria for each of the concurrent applications which are addressed with findings and <br />recommended conditions of approval in the evaluation below. <br /> <br />The site is currently undeveloped, located on the east side of Hawkins Lane and northeast of <br />Randy Lane. Videra Park abuts the property to the south, and the immediate area otherwise <br />consists of low-density, single-unit residential development. As indicated in the applicant’s <br />materials, the proposal includes single-unit, detached housing on 38 lots, with the potential for <br />one or more of the lots to be developed with middle housing types as allowed by State law and <br />the Eugene Code. The applicant also asserts that Lot 39 is proposed to be created so that it may <br />be the subject of a future middle housing development proposal, including a conceptual layout <br />showing Lot 39 as being divided into four (4) future middle housing lots. <br /> <br />For ease of reference, a vicinity map showing the subject area is included as Attachment A, and <br />a copy of the applicant’s site plan is included as Attachment B. These materials help to show the <br />current subject property in context with the surrounding area and the layout of the applicant’s <br />proposed lots, private streets and other infrastructure to serve the proposed development. A <br />brief discussion of the land use history of the subject property leading to the current <br />applications under review is also provided for background purposes below. <br /> <br />In 2018 the applicant received a Tentative PUD approval for the same site, Braewood Hills 3rd <br />Addition PUD Phases 5 & 6 (PDT 18-4), to create a similar 36-lot residential subdivision. The <br />2018 approval was appealed to the Eugene Planning Commission, which issued a Final Order on <br />June 25, 2019, affirming the Hearings Official’s decision with revised conditions of approval. The <br />Planning Commission’s decision was appealed to the Land Use Board of Appeals (LUBA). On <br />November 19, 2019, LUBA issued a Final Order (2019-067) affirming the Planning Commission’s <br />decision. The 2018 tentative PUD approval expired on June 11, 2024.1 <br /> <br />On September 8, 2023, the applicant filed new applications for Braewood Hills 3rd Addition (PDT <br />23-1 and ST 23-3) for concurrent Tentative PUD and Subdivision approval to create a 39-lot <br />residential subdivision under the approval criteria in EC 9.8325 “Tentative Planned Unit <br />Development Approval Criteria - Housing/Clear and Objective”. Those applications became void <br />on March 7, 2024, because the applicant did not submit fully complete application materials <br />within the specified 180-day period for completeness review following initial submittal in <br />accordance with EC 9.7015. <br /> <br />A new set of applications were submitted on March 29, 2024 (PDT 24-1 and ST 24-3).
